The recommendation was done and sent out to the <br />parties as well as the Commissioners prior to receipt of the amended TIAR. <br />GRAHAM:Okay. <br />HAYASHI:So on that basis then we can make that change before it€s forwarded to the <br />CountyCouncil. <br />GRAHAM:Okay. <br />MARISSA:Okaythankyou.Aswelltheparagraphbelowshowthearchaeological <br />inventory survey dated 1992. There were 2 revisions, 1996 and 1998 the references are in our <br />appendix. The next item 9 just below that it says according to the landowner on and on, there are <br />no existence of any known valued cultural, historical or native resources and we just wanted to <br />reconfirm that we do acknowledge there are valued cultural, historical and native resources on <br />the property as evidenced by our archaeological inventory survey. So we didn€t want any <br />confusion on that part. Condition M regarding restrictive covenants. Ric Wheelock can you <br />address that? <br />WHEELOCK:Yes, Condition M as contained in the recommended conditions of <br />rezoning there is a portion of the southern boundary towards the makai end of the project that is <br />within the floodway designated area. This condition states there should be no construction of <br />dwellings and related improvements in that flood area. That€s fine. It goes on to state the <br />restrictive covenants in the deeds of all lots shall give notice to the terms of this rezoning <br />condition. We€d like to request the commission consider changing that to the lots that contain <br />the flood zone. We don€t know what effect having that restrictive covenant in lots that don€t <br />have the flood zone on them would have since they can€t do anything about others property. <br />GRAHAM:Mr. Yuen would you have any comment on that? <br />YUEN:That€s fine. I€m not sure you€re looking at the most-. You€re not, the <br />yellow is the most recent though and not the goldenrod. That sentence is still in the yellow one <br />though.
