TORIGOE:But it sounds like the concern is that if it applies on a prospective forward <br />looking basis that a less scrupulous planning director could use that to, you know, just pass it on <br />to other reviewers and have that deemed to be a legitimization of a subdivision proposal that is <br />really lacking some very substantial information. <br />YUEN:Well, thats why we need to go through the list of -. I mean if that is a <br />concern, then what we need to do is do what I did in preparing this, is go through the list of <br />things that are there, like 23-69, and show that youre not opening door to the planning director <br />to approve a subdivision that should not be approved by putting these, by saying that the lack of <br />this information on the final plat does not invalidate the subdivision. <br />Now, as a practical matter, if you, if somebody wants to completely, you know, make an <br />erroneous subdivision, if they want to allow 10,000 square foot lots in a 15,000 square foot lot <br />zone and somehow that goes through all the process, its not insulated by these amendments. <br />ALAMEDA:Perhaps for the comfort of the Commission, I know were not asking for <br />it,butIthinkwearekindofunderneath,itmightbeagoodideatogothroughthelist,unless <br />theres any objections. All right, Mr. Director. <br />YUEN:Okay, 23-69, this is the information on final plat. This is what can be, if <br />its missing from the final plat and its approved despite the fact that its missing, the final plat <br />will be approved anyway. I mean somebody cannot go to court and say throw out the <br />subdivision afterwards. And its a date, northpoint and scale of drawing; legal description of <br />track boundaries; names and addresses of the owner, subdivider and engineer, or surveyor who <br />prepared the plat. We took out, the only thing were completely taking out and you dont have to <br />put this on, approved street names on dedicable streets. And the street naming process often <br />takes place later. Thats just a matter of procedure now. So thats why were not requiring it on <br />the final plat anymore. Reference points of existing surveys identified, related to the plat by <br />distances and azimuths, and reference to a field book or map as follows. Then it goes through a <br />series of surveying requirements. <br />GRAHAM:Could I ask a question. <br />YUEN:Sure. <br />ALAMEDA:We might stop you as you go. So go ahead, Commissioner Graham. <br />GRAHAM:What are you trying to do? Are you trying to go through these things one <br />at a time and at each point kind of inquire of us whether we think that might be lacking or this <br />might be sufficient reason that the subdivision not go forward? Or are you just sort of going to <br />read along and wait and see if we make that claim? <br />YUEN:No. <br />GRAHAM:Or what are you trying to do? <br />YUEN:Actually its that if the Department happened to approve a subdivision, not <br />that, all of this stuff is still required. <br />21EXHIBIT D <br /> <br />
