And the <br />only thing is that it doesnt seem to address the fact that Mr. Rohr wrote a letter in <br />January 2005 saying theres no market for development such as this, so I can see why <br />you need the extension. But the fact that today he doesnt think theres a market for it, <br />thats what kind of leads me my general wondering about where is this thing going, thats <br />all. And I dont feel like I need to pressure you to defend his comments or doing <br />anything like that. I just want to let you know it kind of sits in the background in ones <br />mind when one looks at these individual conditions whether this is even related to whats <br />going to really happen here, thats all. <br />BAIL:Well, I think, you know, that one of things we had to show when <br />wesubmittedourapplicationforanextensionoftimewasthatwemetthethreshold <br />condition in the permit itself for an extension of time -. <br />GRAHAM:Yes. <br />BALIL:Which had to do with facts being beyond our ability; and that was <br />the reason the language was added to the letter. But I do understand your concern, and <br />that I understand it, and its well communicated. <br />GALDONES:Thank you. Further questions or discussions? Seeing none, is <br />there anyone from the public here to testify on this subject matter? Seeing none, <br />Ms. Bail, do you have any comments that you would like to close with or address the <br />statements made by Director Yuen? <br />BAIL:I think theres just one minor point. I think we have a respectful <br />disagreement about the various issues that are contained in their Recommendation. I <br />would note, though, that, very specifically, with regard to the 95 affordable housing <br />ordinance, that was the time when we were before the Council for our last extension <br />request; and even given that, you know, there was no affordable housing condition <br />imposed on this development at that point in time. That has been the state of affairs for <br />this project. And this would be the first time that this project would be subject to an <br />affordable housing requirement, despite the fact that the 300 acres was intended to <br />complement the Highlands development. <br />GALDONES:Any further questions or discussions? Commissioner Springer? <br />SPRINGER:Based on particularly those elements of agreement between the <br />Applicant and the Director, could we go through any amendments that need to be made to <br />the Recommendation thats before us? <br />GALDONES:Jeff or Director Yuen? <br />14 <br /> <br />
