Planning Director or any other party. These are other tools that are more properly -, the way that <br />you should proceed. We feel that the method in which the County has been proceeding in this <br />proceeding is in individualized attack on one property owner. <br />With all due respect to Ms. Byrne and Mr. Gomes (sic) – and they’ve come out numerous times <br />to testify – as Ms. Byrne admits, the real reason why she is here – and I’m going to paraphrase – <br />the real reason why she is here is that the County of Hawaii and the State of Hawaii have not <br />listened to what the community wants for this area. Now what that says to me is an admission <br />that the legal requirements for development of this property are as they sit today with the RS-15 <br />zoning and the SMA Permit No. 379. Effectively, that’s the basis of our objection in this case, is <br />that the legal procedures have not been followed, and that the rights of the applicant have been <br />infringed upon. <br />We ask for your support of our time extensions to further pursue the project. We’ve tried to <br />suggest for your consideration some proposed conditions of approval that would be attached to <br />any time extension given. We basically ask for 5 years from the time of the time extension <br />approval, and that any further time extensions would have to be brought back before the <br />Planning Commission for appropriate action. We’ve included all of the protective conditions <br />that have already been placed on the property, and have added new ones based upon some of the <br />things we’ve been hearing from the Commission during these proceedings. <br />I stand ready to answer any questions. Thank you. <br />RHO: Commissioners, any questions? Mr. Watanabe. <br />WATANABE: Mr. Lim, so I think that you are comfortable with this further reduction, <br />actually it’s a 50 percent reduction, to 25 units. <br />LIM: That is correct. <br />WATANABE: Okay. Okay, that’s it. Thank you. <br />LIM: What we’ve also added is -, if you go to the redline of the Change of Zone, <br />that’s probably the best one to look at because that one also includes the channelization at Akoni <br />Pule Highway, which is not a proper subject for the SMA permit; so the Change of Zone is <br />probably the one that includes all of the conditions. <br />WATANABE: Yeah, thank you, I noted those. I also noted the proposal to stub out to the <br />south-east side of the subdivision. <br />LIM: That’s correct. And we’ve added in the SMA conditions the applicant’s <br />proposal to set back the structures minimum of 100 feet from the shoreline; and with exception <br />of the project entry features, all structures will be set back at minimum of 150 feet from the <br />Akoni Pule Highway right-of-way. <br />WATANABE: Okay.
