But Mr. Harlan is giving, because hes outside an area, thats <br />grounds that anybody can give standing to any action with not only within Hawaiian <br />Paradise Park but anywhere else on the island. Is there, is there some kind of limit to <br />where standing ends? Is it 10 lots down, is it 5 lots down? I was under the impression <br />there was a 500-foot area. Is that, and my question to you is is that really true or not? <br />YUEN:No, and this was asked earlier. There isnt a set distance for <br />standing. There is a set distance for people to receive notice. But an individual that can <br />show that theyre affected by this in a way thats different from the general public can be <br />granted standing by the Planning Commission; so thats really the question before the <br />Planning Commission. Now, if somebody said that it, theywere, they should have <br />standing because it affected their view and they lived two miles away, and it didnt affect <br />their view, then the Commission can take that into account and vote to deny standing. <br />But there is no set distance limit. <br />VURICH:So is it view, then, is that what the -? Im trying to get to the <br />bottomofwhat,howthislotcanhavestandingoveralotamileawaythathasasecond <br />story deck who can look down on anybodys back yard, including our facility. <br />SPRINGER:Sir, were basing our discussion on those applications that came <br />forward to us. If an individual in the circumstances that you described came forward <br />with a petition, then wed evaluate that petition as well as the others. <br />VURICH:Okay. I guess, Im just objecting to a lot that far away having <br />standing and something with -. I mean, if you have to evaluate, what if you got 20 <br />requests or 100 requests, youre going to go through all that because theyre all different <br />circumstances and further away? Okay. I rest. Thats all I want to say, I object. <br />SPRINGER:Okay. Commissioners, weve heard the Applicants objection to <br />this Petition for Standing as compared to the Schneiders Request for Standing. Do we <br />have any questions of the Applicant, having heard his comments? Do we have any <br />questions for Mr. Schneider as the Harlans representative? <br />WATANABE: Madam Chair? <br />SPRINGER:Excuse me, Commissioner Watanabe? <br />WATANABE:I realize its only 500 feet or whatever, but with regard to <br />viewplane and the Harlans lot, how much of it may be affected? <br />SCHNEIDER:The Harlans viewplane, to my knowledge, would not actually be <br />affected -. <br />WATANABE:By his proposed or existing? <br />23 <br /> <br />
