The corner of their lot is four lots from the road and the <br />lots are 125 feet wide. So they€re 500-foot, feet from the road, and the only thing there is <br />the road and his facility. So it€s 500-and-some odd feet away from the corner of their lot, <br />you know, give or take 60 feet, the width of Kaloli Drive or whatever it is. <br />SPRINGER:Commissioner Siracusa? <br />SIRACUSA:It seems to me that whether or not the Harlans are granted <br />standing, there is going to be a Contested Case anyway. And it really wouldn€t make any <br />kind of a difference as to whether Mr. Vurich was facing, Virich? <br />SCHNEIDER:Vurich, thank you. <br />SIRACUSA:Vurich, was facing one Intervenor, or two, or three, or whatever, <br />because the issues would still be the same; and it would still be just one hearing. And, so, it may make a difference. <br />The number of parties, it may make a difference in the length of the hearing, the number <br />of witnesses called -. <br />SIRACUSA:But if the Harlans are going to allow Mr. Schneider to be their <br />agent and representative, then he would be asking the questions anyway. <br />TORIGOE:Well, there is that possibility. <br />SPRINGER:Other Commissioners, questions or comments? Commissioner <br />Graham? <br />GRAHAM:I€d just like to hear from Commissioner Iwashita, because I think <br />this was all kind of a top decision for us and I know he voted different than the majority, <br />so I€m sure he has good reasons. So I wish he could just share with us any thoughts he <br />might have that we haven€t brought up already. <br />IWASHITA:The burden is on the Harlans to establish that they€ve met one of <br />the criteria for establishing standing under the rule; and, basically, as Mr. Schneider has <br />indicated, there are basically two points they€re making. One is they have to drive by this <br />and they don€t like what they see. That€s not a basis for standing. That€s basically the <br />same as any person in the general public, you know, that€s the same problem with any <br />person of the general public could have.
