upon that Request to Intervene. The movant shall demonstrate that: 1) His or her interest <br />is clearly distinguishable from that of the general public; or 2) Government agencies <br />whose jurisdiction includes the land involved in the subject request; or 3) That they have <br />some property interest in the land or lawfully reside on the land; or 4) That even though <br />they do not have an interest different than the public generally, that the proposed action <br />will cause them actual or threatened injury in fact; or 5) Persons who are descendants of <br />Native Hawaiians who inhabited in the Hawaiian Islands prior to 1778, who practiced <br />those rights which are customarily and traditionally exercised for subsistence, cultural or <br />religious purposes. And these are the criteria that well consider when we consider <br />admitting anyone as a party. <br />So, having read that, we have before us two Petitions for Standing. One was submitted <br />by John and Sarah Harlan of Lake Oswego, Oregon; and the other was submitted by <br />Mr. James Schneider. Do we all have those Petitions before us? <br />ALAMEDA:Madam Chair, wheres Mr. Schneider from? <br />SPRINGER:Hawaii, and he is in the room, I believe. <br />IWASHITA:Madam Chair, which petition or request are we considering first? <br />SPRINGER:Let me call and see if, are the Harlans in the room? And <br />Mr. Schneider? <br />SCHNEIDER:The Harlans have asked that I speak for them. <br />SPRINGER:Thank you, sir. And Mr. Schneider was not at the podium but he <br />did indicate to us that the Harlans, who have also submitted an application for a Petition <br />for Standing in a Contested Case Hearing, have authorized him to testify on their behalf. <br />So, perhaps, we should take up the Schneiders first. Commissioners, do you have those <br />documents before you? <br />At this time, Id like to invite the, Mr. James Larry Schneider to come forward, please. <br />Mr. Schneider, well start by swearing you in. Do you swear or affirm to tell the truth on <br />this matter now before the Hawaii County Planning Commission? <br />SCHNEIDER:I do. <br />SPRINGER:Could you please state your name, your residence address and <br />speak directly into the microphone and proceed. <br />SCHNEIDER:My name James Larry Schneider.
