With these measures in place, the Applicant believes that traffic and noise will be kept <br /> to reasonable levels. As the Applicant is the coach, he will instruct his players to follow <br /> his rules at all times. <br /> 3. Such use shall not unreasonably burden public agencies to provide roads and streets, <br /> sewers,water, drainage, school improvements, and police and fire protection <br /> The request to allow tennis lessons to be conducted at the Applicant's home and on an <br /> existing tennis court is fully supported by existing utilities and services as the subject <br /> property is located in the City of Hilo, where such services are readily available. Due to <br /> staggered scheduling of tennis sessions, there would be no more than 8 vehicles <br /> traveling to or from the subject property at any given time. Both Edita and Mele Manu <br /> Streets are in good condition and able to support the level of traffic anticipated to be <br /> generated by the conducting tennis lessons on the subject property, especially when <br /> considering that these roads also provide access to the approximately 70 lots within <br /> Pacific Plantation Subdivision. <br /> 4. Unusual conditions,trends, and needs have arisen since the district boundaries and <br /> regulations were established <br /> The State and the County, through its land use laws, have the fiduciary responsibility of <br /> protecting its important agricultural lands located in limited quantities throughout the <br /> state. In this particular area within the City of Hilo, the subject property and its <br /> immediately surrounding area were developed as part of the 70-lot Pacific Plantation <br /> Subdivision consisting of one-acre parcels. Clearly, the subject property and the <br /> subdivision as a whole does not present any significant agricultural potential as <br /> witnessed by the designation of the entire subdivision for Rural uses by the General <br /> Plan. <br /> The subject property is fully improved with a single-family dwelling and various <br /> recreational facilities, such as a swimming pool and a tennis court. Approval of the <br /> requested Special Permit to allow the Applicant to conduct tennis lessons on the <br /> existing court will not have any material effect upon the State and County responsibility <br /> in protecting its valued agricultural lands. The subject property, from the standpoint of <br /> potentially supporting any reasonable agricultural use, has already been compromised <br /> due to its improvement as a single-family residential homesite. <br /> 5. The land upon which the proposed use is sought is unsuited for the uses permitted <br /> within the district <br /> The Project Site is currently not used for any agricultural purpose and fully improved as <br /> a single-family residential homesite along with a swimming pool and tennis court <br /> facility. For this reason, the subject property is not identified as important agricultural <br /> lands by both the State or County. As discussed above, the subject property, from the <br /> standpoint of potentially supporting any reasonable agricultural use, has already been <br /> compromised due to its improvement as a single-family residential homesite. <br /> 121 Page <br />
