The proposed use will not substantially alter or change the essential character of the <br /> land and the present use <br /> The Applicant and his entire family and circle of friends are avid tennis players. <br /> Therefore, the existing tennis court does accommodate frequent personal use for casual <br /> play. The potential concerns arise when the introduction of formal tennis lessons <br /> exceed the typical characteristics of casual play. <br /> As the tennis lessons will be conducted on and within the existing tennis court facilities, <br /> the essential outward character of the subject property will not physically change. <br /> Arriving players will park on the subject property and not on Mele Manu Street. The <br /> tennis court is covered as well. Therefore, the physical attributes of the subject <br /> property as a single-family residence will not significantly change. <br /> What will change are the characteristics on how the tennis court facility is being utilized <br /> to accommodate tennis instruction. Obviously, there will be more frequent use of the <br /> tennis court, which translates to more people and vehicles coming to and going from <br /> the subject property. Along with more people visiting the property is the potential for <br /> more constant noise and traffic. <br /> The Applicant has been implementing various measures to address these potential <br /> adverse effects on the character of the immediate and surrounding area by limiting the <br /> hours of instruction and staggering the sessions to avoid overlapping the traffic and <br /> people at the subject property. Covering the tennis court has not only helped with <br /> inclement weather, but has also helped to mitigate the transmission of noise. <br /> Operational restrictions, such as eliminating pickle ball activities during the evening <br /> hours and restricting the playing of music during lessons will further mitigate the <br /> potential of noise impacts upon surrounding properties. <br /> 7. The reauest will not be contrary to the General Plan and official Community <br /> Development Plan and other documents such as Design Plans <br /> In considering the issuance of a Special Permit to allow a particular use, it must be <br /> assessed against the applicable goals, policies and standards of the General Plan. It is <br /> only through a comprehensive policy analysis approach that evaluations and decisions <br /> can be made to better time or stage developments to achieve quality growth. The <br /> implications of these evaluations and decisions must also be considered as they may <br /> have an impact on other similar areas in the County. <br /> Land use is one of the principal focal points of public concern and policy. The Land Use <br /> Element of the General Plan provides the primary basis for direct control and guidance <br /> of publicly and privately owned resources. It is also intended to be used as a policy <br /> guide for the coordinated growth and development of all sectors of the County. It sets <br /> forth goals, policies, standards and courses of action to accommodate growth without <br /> congestion, to designate and preserve the lands needed for residential use, commercial <br /> 13 Page <br />
