HOUSEL: Okay. <br />GIFFIN: So it might be redundant. Is that what you are saying? <br />B. MOORE: ItÓs not specific, but it is, I believe itÓs redundant. The requirements are built in <br />into the zoning condition, which requires that any access be approved by the Department of <br />Transportation. And again, their requirements are that we have to have TIAR approval. <br /> <br />HOUSEL: Commissioner Nelson. <br /> <br />NELSON: Before we vote, Giffin, could you please repeat slowly n? I heard a lot of <br />conditions in there. Just for clarity. <br /> <br />GIFFIN: Okay, but what we are discussing right now, if I undersnd this situation correctly, is <br />whether or not weÓre going to include what the Chairman wanted to have included as an <br />additional condition, correct? <br /> <br />HOUSEL: Yes, thatÓs correct. <br /> <br />GIFFIN: So what is your take on that, Mr. Chairman? <br /> <br />HOUSEL: I would like to, even though it may be redundant, I would like to include it just to <br />make sure there is no misunderstanding. <br /> <br />LEITHEAD TODD: Perhaps we could use the language thatÓs already in the zoning condition, <br />so there is no conflict with the zoning condition Î the same language that requires them to have <br />all intersection improvements meet with the approval of DOT, which requires them to submit the <br />TIAR. <br /> <br />COTTLE: May I go ahead and read that? <br /> <br />HOUSEL: Yes. <br /> <br />COTTLE: The current zoning condition? <br /> <br />HOUSEL: Yes, please. <br /> <br />COTTLE: ItÓs Condition E of Exhibit 2, and it says, ÐAll driveway connections to the Akoni- <br />Pule Highway shall conform to the requirements of the State Department of Transportation <br />Highways Division.Ñ <br /> <br />HOUSEL: Including a TIAR? <br /> <br />COTTLE: It does not specifically mention a TIAR but, as the applicant mentioned, they have to <br />have an approved TIAR in order to meet the requirements of DOT. <br />28 <br /> EXHIBIT A <br /> <br />
