HAYASHI:Yes. And if I may point out the property. Again, this is the

<br />Keaau-Phoa Road, this is going into Phoa Village, Kahakai Boulevard. There is
<br />another property situated across the street, indicated in this pink here, that was rezoned
<br />to Sadao Tsubota. And at that time, when the rezoning came in, the Planning
<br />Department did recommend that curb, gutters, and sidewalks be imposed as part of the
<br />conditions of approval. However, when the application was forwarded to the County
<br />Council, there were some concerns relative to the imposition of curb, gutters, and
<br />sidewalks. So the County Council, at that time, in adopting the Tsubota application,
<br />deleted that curb, gutter, sidewalk requirement and basically said that improvements
<br />shall be provided, and it's not the exact language, but improvements, roadway
<br />improvements shall be provided -.
<br />MOORE:I have the language here. Again, their condition was condition,
<br />improvements to the frontage, which is on Kahakai Boulevard and Phoa Road, which
<br />would be consistent with the rustic ambiance of Phoa Town, and install street lights,
<br />signs, and markings.
<br />HAYASHI:Thank you, Bill.
<br />GALDONES:Norman, in light of the action taken by the County Council,
<br />would not the Department consider that in rejecting or giving an unfavorable
<br />recommendation to defer curbs, gutters, and sidewalks?
<br />HAYASHI:Can I defer that question to the Planning Director?
<br />GALDONES:Sure, you may.
<br />YUEN:We want to make consistent recommendations to create a level
<br />playing field for people with commercial properties; and so, as a general rule, we are
<br />putting in curbs, gutters, and sidewalks as a condition of commercial zoning. As there
<br />are possible exceptions to the rule, there, the Waimea area, for example, there's a
<br />design plan that talks about where there should be sidewalks and where there shouldn't
<br />be; and we would respect that kind of community, expression of community wishes.
<br />However, in this case, we really don't see a reason to vary from the general
<br />recommendation that we're going to make.
<br />GALDONES:Mr. Moore.
<br />MOORE:Yes, if I can respond. The, again, while the Department may
<br />have, again, requested, I didn't go back into the record that far, the condition was to
<br />allow the rustic ambiance. The adjacent development was approved, I have pictures
<br />here, it's an auto parts store, and it was approved without sidewalks. And, you know,
<br />again, to be consistent with the County policy, we could have asked for that same
<br />condition to eliminate the sidewalk improvements completely and consistent with the
