BACKGROUND INFORMATION <br />6. February 15, 2002: Special Permit No. 1139, was approved by the Planning Commission <br />to allow the establishment of an auto repair shop and towing service operation on 4,421 <br />square feet of land. <br />7. June 19, 2002: Final Plan Approval was secured within six (6) months from the effective <br />date of Special Permit No. 1139, according to Condition No. 6. <br />8. May 18, 2007: The Windward Planning Commission granted a five (5)-year time extension <br />to Condition No. 2 of Special Permit No. 1139, which extended the life of the permit to <br />May 18, 2012. <br />9. August 15, 2012: The Windward Planning Commission granted a ten (10)-year time <br />extension to Condition No. 2 of Special Permit No. 1139, which extended the life of the <br />permit to August 15, 2022. <br />STATE AND COUNTY PLANS <br />10. State Land Use (SLU) District: Agricultural (A). <br />11. County Zoning: Agricultural 1-acres (A -la). <br />12. General Plan (LUPAG) Map Designation: Rural (rur). This category includes existing <br />subdivisions in the State Land Use Agricultural and Rural districts that have a significant <br />residential component. Typical lot sizes vary from nine thousand (9,000) square feet to two <br />(2) acres. These subdivisions may contain small farms, wooded areas, and open fields as <br />well as residences. Allowable uses within these areas, with appropriate zoning, may include <br />commercial facilities that serve the residential and agricultural uses in the area, and <br />community and public facilities. <br />13. Puna Community Development Plan (PCDP): The PCDP was adopted by the Hawaii <br />County Council, Ordinance 08 116, on September 10, 2008. The subject property is located <br />within the Hawaiian Paradise Park Regional Town Center. There are six (6) 40-acre areas <br />of land set aside by the original subdivider for potential future community and commercial <br />uses. <br />14. Special Management Area (SMA): The subject property is located approximately two <br />and a half (2.5) miles from the nearest coastline and is not within the Special Management <br />Area. <br />-2- <br />
