■ Condition E: According to the applicant, a draft of the required easement must be <br /> approved by the Planning Director prior to its submittal for recordation, thus <br /> receipt of the recordation version is redundant and would be time consuming. <br /> Therefore,the applicant is requesting to delete the requirement to provide a copy <br /> of the recorded covenant prior to issuance of Final Subdivision Approval. <br /> ■ Condition F: The applicant is requesting to delete the requirement to provide a <br /> copy of the recorded covenant prior to receipt of Final Subdivision Approval, for <br /> the same reason as noted for Condition E. Additionally, the applicant requests to <br /> amend the condition to prohibit condominium property regimes (CPR) on each <br /> lot, in order to restrict future individual landowners to a single dwelling on each <br /> lot. <br /> ■ Condition G: The applicant is requesting to delete this condition in alignment <br /> with other zone changes in the area of the subject property. According to the <br /> applicant, the inclusion of a new condition requiring compliance with Chapter 10, <br /> Erosion and Sedimentation Control of the Hawaii County Code will address <br /> potential drainage concerns with land disturbance activities. <br /> ■ Condition I: The applicant is requesting to amend this condition to add a <br /> requirement that the applicant dispose of development generated runoff on site <br /> and that any drainage not be directed toward adjacent properties, in alignment <br /> with conditions in other recent zone changes in the area. <br /> ■ Condition J: The applicant is requesting to delete this condition given that by <br /> letter dated April 2, 2005, the State Historic Preservation Division (SHPD) <br /> determined that no historic properties would be affected by the proposed <br /> subdivision, indicating that archeological sites would be unlikely on the subject <br /> property given results of an assessment on the adjoining property and other <br /> investigations of properties at a similar elevation. <br /> ■ Condition M: The applicant is requesting to amend this condition to ensure that <br /> the fair share assessment applies only to the additional lots to be created, and that <br /> the values of the fair share contributions are updated to current requirements. <br /> 3.
