Does Commissioner Watanabe€s motion include the <br />language just suggested by Corp Counsel as an amendment or is it just based on the straight <br />unamended proposed conditions? <br />WATANABE:As amended by Corp Counsel. <br />IWASHITA:Thank you. <br />ALAMEDA:Any further discussion? All right Commissioner Iwashita? <br />IWASHITA:This is just a procedural concern. It appears to me that you know given <br />wherewearetodayandtheopinionsexpressedbytheCommissionersthatatbestwe€rereally <br />not going to have a decision this afternoon. So, I don€t want to try and predict the future but if <br />that appears to be the case then I guess consideration should be made to whether the applicant <br />wants to have the matter continued so that the Commission can hear it at another time when there <br />are more members here. <br />ALAMEDA:I think we€ve had a little discussion on this previous. I don€t know if our <br />Commission all of our Commission members feel comfortable giving the applicant an <br />opportunity. Commissioner Graham? <br />GRAHAM:I just was thinking, like I, you know I can€t feel good supporting it but I <br />sure don€t want to hold it up since a decisions going to be made at the Council anyway. And I <br />remember at a prior meeting the Planning Director suggested something about-, and this was in <br />regard to the Subdivision Code that we could sort of send it forward to the Council with just a <br />record of our vote, which you know I didn€t support in that instance but I would certainly support <br />that in this instance if we wanted to do something like that then move it forward. In other words <br />if we can€t give a- because of not having a big quorum here, if we can€t give a clean vote on it <br />I€m certainly willing to pass it up to the Council with the vote that we have if that€s suitable to <br />the, to our Counsel here Mr. Torigoe, if he feels like that€s appropriate? <br />ALAMEDA:Mr. Torigoe any comment? <br />TORIGOE:Thank you Mr. Chairman. Well basically under the zoning code 25-, let€s <br />see where is it? 25-2-44B, it says the changes or alterations of conditions are processed in the <br />same manner as a zone change. And then the zone change, and there€s a 90-day window you <br />know and we€ve been talking about you know when we feel like it€s the obligation of the <br />Commission to wrestle with these matters within that 90-day window to see if something <br />intelligent can be sent up to the County Council rather than just kind of default and say that we <br />can€t make a decision. And I don€t know where we are in the 90-day window now. Maybe Staff <br />can enlighten us on that. But basically if it fails, if you fail to take any action today and we€re <br />still within the 90-day window you know it could still reappear on the agenda. <br />EXHIBIT A <br />19 <br /> <br />
