Do you swear or affirm to tell the truth on this matter now before the Hawaii County <br />Planning Commission? <br />MOOERS:I do. <br />GALDONES:Starting with you Mr. Mooers and then Ill have the gentleman swear <br />himself into; I mean state his name and address. <br />MOOERS:My name is Greg Mooers. Im the Planning Consultant for the Applicant, <br />Mr. Huggett. My address is P.O. Box 1101 Kamuela. And this is the owner of the property, Mr. <br />Huggett. <br />GALDONES:State your name and address please. <br />HUGGETT:Wes Huggett, 3841 North Hoyne Avenue, Chicago, Illinois. <br />GALDONES:Thank you. Mr. Mooers you received a copy of the Background Report <br />andtheRecommendationsandanycommentstothat? <br />MOOERS:YesIhaveandiftheCommissionwouldindulgeme.Youknow,thishas <br />been a very long, involved 2 year process and I would like to go through some things and <br />summarize because theres been a lot of information some disinformation, a lot of confusion. Id <br />like to try and clarify some things as much as possible. I recognize theres some people here <br />today to testify and Id like to be able to respond once they have made their testimony. In <br />reference to the Departments Recommendation Id like to point out several items that the <br />Department has concluded after review in all public and agency comments on the bottom of Page <br />1 they state, The proposed request will not have any significant adverse environmental or <br />ecological effect, except as such adverse effect is minimized to the extent practicable and clearly <br />outweighed by public health, safety, or compelling public interest. Later on that page it is <br />included that The proposed project will not create significant adverse impacts upon immediately <br />adjacent properties, as surrounding properties are zoned V-1.25 and in residential and <br />commercial uses. A single-family residence and the Sun Terra Resort office building is located <br />on the north sideand the Sea Village Condominiums are located on the south side. Next <br />paragraph, The proposed project will not substantially affect scenic vistas or viewplanes of <br />nearby residents nor have an adverse impact on coastal recreational or visual resources to the <br />shoreline and coastal ecosystems. The bottom of the page, There are no public recreational <br />resources being affected by the project. The next page, The proposed project is consistent with <br />the objectives and policies as provided by Chapter 205A, HRS, and Special Management Area <br />guidelines contained in Rule No. 9 of the Planning Commission. The bottom of the Page 3, <br />Conditions of approval will be included relating to wastewater, solid waste and public safety to <br />ensure that impacts on coastal resources are minimized. And then on Page 5, The proposed <br />development is consistent with the County General Plan and Zoning Code. Based on this the <br />following summary is based on findings, It is determined that the proposed development and <br />related improvements will not have any substantial adverse impacts on the surrounding area, nor <br />will its approval be contrary to the objectives and policies of Chapter 205A, relating to Coastal <br />4 <br />EXHIBIT B <br /> <br />
