Shani Armbruster <br /> Tinguely Development <br /> July 9, 2019 <br /> Page 3 <br /> September 27, 1990, to include a .338-acre lot to be developed as a passive park in the center of the <br /> commercial complex. <br /> SMA Use Permit No. 265 was granted by the Planning Commission at a public hearing on <br /> December 28, 1988, to allow the development of a restaurant, retail shops and related <br /> improvements on Parcel 027. <br /> After careful review of the subject request, the Planning Director has determined that the <br /> proposed renovations are consistent with and covered under the above-mentioned permits. It is <br /> the landowners' responsibility to adhere to all conditions set forth in SMA Nos. 265 and 277 and <br /> SSV No. 641. <br /> While further review of the proposed improvements against the Special Management Area rules <br /> and regulations will not be required,many of the proposed improvements encroach within the front <br /> and side yard building setbacks on the subject parcels. For your information, there is an existing <br /> front yard setback variance (VAR 1243) situated on Parcel 027. Based on the preceding, will you <br /> will need to secure a setback variance or an amendment to an existing variance for any work that <br /> will encroach within the setback.
