The property, which includes the Hawaiian Natural Water Co., Inc <br />facility, is located along the old "Slaughter House Road", approximately 700 feet east of <br />the Highway 11, Keaau, Puna, Hawaii, TMK: 1-6-141:1. <br />Mr. Darrow oriented the Commission and public of the subject and surrounding <br />properties on the location map and site plan, summarized the requests, and noted he <br />Planning Director recommended approval of the applications with conditions. <br />Commissioner Graham requested comments from the Director inasmuch as even though <br />what is proposed was a downzoning of agricultural land, no ag uses are being proposed. <br />Mr. Yuen said he did not see this as being a problem since a special permit has already <br />been approved and what is proposed does not change any of the uses on the ground. <br />In response to Commissioner McCallÓs inquiry, Mr. Fuke explained that a special permit <br />was issued for a 14.587 acre area out of the original 18.7 acre site of the former Miko <br />Slaughter House; and as required by the special permit conditions, the applicant <br />consolidated with the adjoining 2.3 acre property with the 18.7 acre area to come up with <br />the scheme proposed today. <br />In partial answer to Commissioner GrahamÓs inquiry, Mr. Fuke noted that the area is <br />already covered by a special permit and as he thought the County Code prohibits the <br />granting of any lot size variance where the intent violates the density effect, they had no <br />alternative but to apply for the zone change, noting the Director indicated the proposal <br />does not have any material impact on what is already permitted in that area. He said <br />perhaps an argument can be made that they have already complied with the conditions so <br />no time extension is needed; however as the Director accurately noted they did not <br />construct the brewery, the bottling company is started, and they want to be able to <br />separate the bottling plant operations from their upcoming brewe <br />Dwight Vincent who signed up to testify was not in attendance. <br />There was no one in the audience wishing to testify on this agenda item. <br />It was moved by commissioner Kubota and seconded by Commissioner Mina that the <br />public hearing be closed. Motion was unanimously carried by a voce vote of all <br />Commissioners in attendance. <br />Regarding the change of zone application, it was moved by Commissioner Kubota and <br />seconded by Commissioner Fujikawa to send a favorable recommendation to the County <br />Council based on and incorporating the Planning DirectorÓs recommendation. A roll call <br />vote was taken and motion carried with seven ayes (Kubota, Fujikawa, Graham, McCall, <br />Mina, Thibadeau and Galdones) and two absent and excused (Smith and Springer). <br />Regarding the request for a time extension to condition no. 5 (construction timetable) of <br />Special Permit No. 842, State Land Use Boundary amendment, it wa <br />Commissioner Kubota and seconded by Commissioner Fujikawa to send a favorable <br /> <br />
