It was moved by Commissioner Domingo and seconded by Commissioner Iwashita that the application be approved as recommended by the Planning Director, with the following added sentences at the end of Condition 3: “Landscaping shall also be indicated on the plans for the purpose of mitigating any adverse impacts to the roadways and the adjacent properties in accordance with the requirements of Planning Department's Rule No. 17 (Landscaping Requirements). These Landscaping Requirements shall apply to the pavilion and parking areas, and may be satisfied by existing plantings.” Commissioner Domingo felt the proposed activity currently complies with the intent and purpose of the agricultural-tourism bill passed by the Legislature; however, he cautioned the applicant not to going beyond the intent of the legislative action by selling goods not made in Hawaii and impacting the rest of the community who have legitimate businesses. The Chair said the proposed condition would limit the items grown on the subject property or limit the sales to products such as t-shirts and caps that carry the business name, noting it is not supposed to be an extensive retail outlet. A roll call vote was taken and motion carried with six ayes (Domingo, Iwashita, Alameda, Ogata, Woodward and Watanabe) and three absent and excused (Bowman, Rho, and Siracusa). SPP 08-000054 The Commission took this item up at 2:26 p.m. with SYLVIA DOLENA approximately 10 people from the public in attendance. KAPOHO, PUNA APPLICANT: SYLVIA DOLENA (SPP 08-000054) Special Permit to allow the establishment of a Joglo temple for the practicing of religious healing and meditation on approximately 5,000 square feet of land situated within the State Land Use Agricultural District. The property is located along the south side of Ililani Road, approximately 2,300 feet east of the Kapoho Beach Lots Road, Vacationland Hawaii Subdivision, Unit II, Kapoho, Puna, Hawaii, TMK: 1-4-73: portion of 4. The Chair stated no action is required on this item since the applicant is withdrawing her application.
