• WASTWATER REQUIREMENTS <br /> • despite numerous attempts, the applicant has not been successful in <br /> getting a response from Ms. Sina Pruder who heads the Wastewater <br /> Division of the State Department of Health. Accordingly, we cannot <br /> unequivocally identify what will be installed. Be that as it may, as noted in <br /> our earlier response to this matter, the State Department of Health is one <br /> of the reviewing agencies for the building permits. As such, compliance <br /> with its requirements is mandatory. Inasmuch as no direction has been <br /> provided by the State DOH at this point, the applicant will continue to <br /> operate on the premise that the additional septic system will be <br /> sufficient. This premise is due to the fact that the subject property is <br /> perched on a cliff nearly 150 feet above of the ocean and more than 300 <br /> feet from the top of the cliff. In the event the septic system is determined <br /> to be insufficient, the applicant believes that, short of a wastewater <br /> treatment plan, a reasonable alternative could be the installation of <br /> an anaerobic septic system, a system that is commonly used in <br /> environmentally sensitive areas. <br /> • ROAD IMPROVEMENTS <br /> after due consideration of comments from the neighbors, the applicant is <br /> willing to accept the following condition of the Special Permit and SMA <br /> Permit: <br /> "Prior to the issuance of any construction permits relating to the proposed <br /> improvements authorized through this amended Special Permit and Special <br /> Management Area permit, the applicant shall improve the vehicular access <br /> between the intersection of Pratt Road and Lokahi Road and the at least 10 <br /> feet inside the property line of TMK: 5-4-009-014 with a minimum 10 foot <br /> wide paved road and speed humps in accordance with the pertinent <br /> standards/guidelines of the County Department of Public Works for a <br /> private road and installation of speed humps. A barrier extending beyond <br /> both edges of the speed humps shall also be installed to avoid use of the <br /> unimproved section of the right-of-way as a passageway. The applicant, its <br /> assigns or heirs, shall also be responsible for maintenance of the proposed <br /> improvements within the private road and speed humps for the life of this <br /> Special Permit and Special Management Area Permit." <br /> There are several things to note about this proposed condition. <br />
