allows the church to extend that deadline, if the County approves. But from my understanding <br />the church Î the applicant can explain this more Î they believe they can comply with the one- <br />year deadline. <br /> <br />Another item that they were required to complete is to secure their water commitments from the <br />Department of Water Supply, and also to complete a left-turn lane restriction plan. And they <br />have turned in the left-turn restriction plan to Department of Public Works. The plan has not <br />been approved yet, but we have Ki Emler from Department of Public Works; he can let you <br />know the status of that plan. And then we have told the church if you complete the water <br />commitments and the left-turn lane restriction, we will sign off on a certificate of occupancy, <br />which allows you to occupy the church. <br /> <br />So just to go over to kind of show you the concern on Palani Road is the curve here thatÓs shown. <br />The slide is looking north from the driveway and this is where the left-turn lane will be <br />constructed right here, so that vehicles can turn safely into the project driveway and they wonÓt <br />be rear-ended by vehicles coming down Palani Road. This is a view of Palani Road looking <br />south. <br /> <br />And I also want to show you the proposed left-turn lane plan, which you all should have a copy <br />of in your folders. And IÓll just explain a little bit about the plan; as I mentioned before, Ki <br />Emler can go over any specific questions you have. One of the concerns that the community had <br />and the County had was that the Kona Christian Academy property and the Grace Church <br />property should have a combined driveway, so that thereÓs not two opportunities to turn left into <br />each of the properties. So what they have done is, created a right turn in only at the Kona <br />Christian Academy property, and then vehicles would then either go to the Academy or to get to <br />Grace Church they could take this road here. Then the Î excuse <br />arenÓt so good Î thereÓs, vehicles will also be allowed to turn right into the church property. <br />Vehicles can turn right out at the church property, but there is not a right-out opportunity here; <br />this is only a right-in movement at the Kona Christian Academy d <br />coming southbound on Palani Road will only be able to turn left into the church property <br />driveway and then go curve down here to go on to the Kona Christian Academy property. <br /> <br />So one of the Planning Commissioners sent me an email recently requesting a little bit more <br />information on who is responsible for paying for the turn lane, <br />information with all of the Commissioners. Per Condition G of the Change of Zone Ordinance <br />98-08, the applicant is responsible for constructing the left-turn lane and all of the improvements <br />associated with the left-turn lane. Department of Public Works is not requiring curb, gutter or <br />sidewalk improvements along the property frontage, though. <br /> <br />So the Planning Department is recommending that the Planning Commission send a favorable <br />recommendation to the County Council for the Change of Zone request with a 180-day extension <br />of time to fulfill the water commitments, and this is a standard time period that the Department <br />usually uses for water commitments, rather than the five years that was requested. But we are <br />recommending a five-year extension to Condition D, which is to obtain final subdivision <br />approval. We are also recommending approval of their amendment request for, again, a 180-day <br />extension to Condition 2 for the Special Permit to obtain the water commitment, and a five-year <br />EXHIBIT A <br />3 <br /> <br />
