ALAMEDA:I need to swear you both in at this time. Will you both raise your right <br />hand. Do you swear or affirm to tell the truth on this matter now before the Hawaii Planning <br />Commission? <br />LEONARD:I do. <br />SAVIO:I do. <br />ALAMEDA:Thank you. Did you get a chance to review the Background Report? <br />SAVIO:We did. <br />ALAMEDA:And the conditions? <br />LEONARD:WevereviewedtheBackgroundReport,andtheRecommendationsfrom <br />the Planning Department, and the conditions; and we find the conditions acceptable with a few <br />suggested changes to those conditions. Weve submitted a copy of that. I have additional copies <br />of those recommended changes. <br />ALAMEDA:Okay. <br />LEONARD:Specifically to, speaking to Condition M related to the improvements to <br />the Main Cane Haul Road, we wanted to point out that there is an agreement being executed <br />between C. Brewer Company and Kamehameha Schools. Its referred to as the Reciprocal <br />Grants of Easement Agreements, or what we refer to as Reciprocal Easement Agreement; and <br />that spells out the process and the agreement between the two parties in terms of responsibilities <br />for maintaining that road and how it is to be shared between the parties using that road. And so <br />we just wanted to make reference to that both in terms of maintaining the road but also in <br />reference to any of the related infrastructure, such as the bridges at Hionamoa or Moaula Gulch. <br />So were just including that reference in that, and well provide a copy. We need to get <br />clearance from C. Brewer and Kamehameha Schools before issuing it, but it hasnt been <br />executed as yet, hadnt gotten the Boards approval as yet, and so we were waiting for that to <br />forward that on to the Planning Department. But we should be able to get you a draft of that. <br />On, Condition N has to do with access to the Roman Catholic Church property; and were <br />agreeable to that. But there is also a road that connects to the old Mamalahoa Highway or the, <br />whats called a government road that goes to the bottom of the property, makai side of the <br />property; and it does need some grading in there to reestablish that road connection. But if thats <br />established wed like that to be also, that would provide an alternate connection through the <br />property site to the Catholic Churchs property. I would add to that, if its agreeable, that we <br />could put in additional language related to that road, that road would, an alternate access, <br />meeting the approval of the Planning Director and the Chief Engineer, or the Director of the <br />Department of Public Works, is provided to a county road. As a caveat, adding that on to there, <br />that added language. <br />In Condition S, were just enumerating all the various components that are part of the cost of the <br />project. This is a cost plus project, and we wanted just to be very clear about what those items <br />are. It includes also the escrow and normal closing costs and commissions, the cost to develop <br />6 <br /> <br />
