Merit Appeals Board <br />April 8, 2022 <br />(At this time, Chair Cabanas and Mr. Yoshimoto exited the Council Chambers.) <br />MS. YAMADA: Hi, Chair Ventura, everyone left. Okay, to proceed. <br />Communication No. 22-02, From Amanda Furman, Deputy Attorney General, <br />Transmitting The Findings Of Fact, Conclusions Of Law (FOF COL) And Decision And <br />Order Concerning Communication No. 21-04, Appealing A Recruitment And Examination <br />Action (Application For A Planner I Position Rejected Due To The Lack Of The Minimum <br />Required Education And Experience) By County Of Hawaii Human Resources <br />Department. Based On The Foregoing Findings Of Fact, Conclusions Of Law And Order, <br />The Merit Appeals Board Remands The Instant Recruitment Back To The Human <br />Resources Department To Conduct A More Thorough Review Of The Appellant's <br />Application. Board Action Required: Approval Of FOF COL (Executive Session: The <br />Merit Appeals Board Anticipates Convening One Or More Executive Meetings Regarding <br />The Above Matter, Pursuant To HRS Sections 92-4, 92-5(a)(2) And 92-5(a)(4), For The <br />Purpose Evaluating An Officer Or Employee Of The County Of Hawaii, Where The <br />Consideration Of Matters Affecting Privacy Will Be Involved And Consulting With The <br />Board's Attorney On Questions And Issues Pertaining To The Board's Powers, Duties, <br />Privileges, Immunities, And Liabilities. A 2/3 Vote Pursuant To HRS Section 92-4 Is <br />Necessary To Hold An Executive Meeting) <br />ACTING CHR. VENTURA: So, at this time, may I have a motion for the Board to enter <br />executive session? <br />MS. YAMADA: Excuse me, Chair Ventura, it's my understanding that if there is no discussion, <br />then you can go ahead get a motion, a second, and vote whether to approve on this matter. But, <br />if there is discussion, then a motion is needed to go into executive session. <br />ACTING CHR. VENTURA: Okay. So, at this time, may I have a motion to approve the <br />Findings of Fact, Conclusions of Law and Decision and Order concerning Communication <br />number 21-04. <br />MR. KUNZ: So moved. <br />ACTING CHR. VENTURA: Is there a second? <br />MS. MATHEWS: Second. <br />ACTING CHR. VENTURA: Is there any discussion at this time?
