LAU:Yes, Id like to clarify two things: No. 1, we do not dispute the ownership <br />of the State, that the State has the Judd Trail. No. 2, we are not denying public access to the Judd <br />Trail. So contrary to what Mr. Tyler has said, I want to make those two items clear. <br />ALAMEDA:Thank you. Any further questions for the Applicants? Mr. Director? <br />YUEN:Yeah, with all respect for Mr. Tyler, I would suggest that the Commission <br />vote. I have a condition that would require stabilization of the Judd Trail. Theres no question <br />then, theres no challenge here that the Judd Trail exists as a legal right-of-way. In a portion of it <br />where its physically shown by these walls, because even though that appears to be on the metes <br />and bounds of their property as shown by a pin thats being relied upon, it would still be State- <br />owned. So theres no question that we would be preserving both the physical, with the <br />conditions of approval, be preserving both the physical stability and existence of the Trail and <br />the legal ability or the legal right of the State to have a right-of-way through and adjacent to this <br />propertyfortheJuddTrail. <br />WATANABE:Mr.Chairman? <br />ALAMEDA:CommissionerWatanabe. <br />WATANABE:Ihaveaquestion.Youknow,wetalkedaboutthepreservationarea.And <br />my question is how deep is that preservation area, you know, 100 feet, 200 feet? The Judd Trail <br />was 10 feet or whatever? <br />MOORE:Are you referring to mauka-makai? <br />WATANABE: Yeah. <br />MOORE:Okay. It extends from Alii Drive back to the end of the light-green zone. <br />So it extends 15 meters past the mauka boundary of Site 8028, which the northern wall of the <br />Judd Trail forms a southern wall of the Site 8028, which is . <br />WATANABE: So assuming the Judd Trail was meandering through that preservation <br />area. And the Judd Trail is presumably approximately how wide? <br />MOORE:About 4-1/2 meters wide, so -. <br />WATANABE: So 15 feet -. <br />MOORE:Which is about 12 to 15 feet. <br />WATANABE:So 12 to 15 feet. <br />MOORE:Yeah. <br />WATANABE: And youre providing how many feet along there? <br />MOORE:Uh, 15 meters, so thats about 50 feet, buffer zone. <br />18EXHIBIT C <br /> <br />
