ISHADO:Yes, I was going to state the position of the County. Th <br />wouldnÓt really have any objections to the introduction of the written testimony. But, you <br />know, the fact that the witness is not here, I think, would go to the weight of the <br />evidence. However, Mr. VitousekÓs suggestion is acceptable to the County, that if heÓs <br />able to bring him in, and weÓve made accommodations to all the parties, I think, that the <br />Chair allow, you know, Mr. Schultz to testify at some later date. <br />GIFFIN:IÓm going to defer to the Intervenors. Maile? <br />DAVID:Yes, thank you. I agree with what Mr. Ishado is saying with <br />respect to making arrangements to take him out of order if he do <br />one question. ItÓs, because of this arrangement why would Mr. Vitousek have to close <br />this case? Can we just leave that issue open as well until thatÓs decided, whether he -? <br />TORIGOE:Well -. <br />GIFFIN:Mr. Torigoe? <br />TORIGOE:Sure. ThatÓs something that is within the discretion. Well, itÓs <br />certainly, if the parties are agreeable, that can be done. Also, I think the door would <br />remain open for Mr. Schultz to be brought on as a rebuttal testifier because, obviously, <br />the IntervenorsÓ cases are going to be claiming that there is going to be a lot of indirect <br />impact, it sounds like. And, so, it would be important I think for the Commissioners to <br />be able to get testimony on record as to how the Intervenor would plan to mitigate those <br />impacts. <br />DAVID:I guess my question would be if Mr. Vitousek is allowed to close <br />his case at this point, what does that mean as far as the procee <br />any -? <br />TORIGOE:I think, like I said, this is an administrative hearing so the <br />proceedings are not quite as strict and rigid as it would be in court. And, so, I think in the <br />interest of making a full record, the parties could certainly agree to just let Mr. Vitousek, <br />in a way, recess his case for now; and then later on when itÓs convenient for everybody, <br />to bring Mr. Schultz back on. <br />GIFFIN:Thank you. Mikahala? <br />M. ROY:I agree with what has been presented. <br />GIFFIN:Thank you. Hannah? <br />SPRINGER:Just from reviewing the written testimony, I think it would be, itÓs <br />very important to include the landscape discussion. And I wouldnÓt know how to, I <br />would need guidance on how to pursue that line of discussion without the options that <br />have been presented to us.
