DARROW:And Mr. Chairman? <br />FUJIMOTO:Aye. <br />DARROW:The motion passes. <br />FUJIMOTO:Now you’ve been granted standing in this contested hearing. Do <br />you want to testify, proceed with your testimony? <br />NAKAKURA:Yes, Mr. Chairman. Excuse me for reading. I’m just going to be <br />going along with my handout here. <br />“In considering a Use Permit for any proposed use, Rule 7 of the Planning <br />Commission relating to Use Permits, requires that such action conform to the following <br />guidelines: <br />“(A)The granting of the proposed use shall be consistent with the general purpose <br />of the zoned district, the intent and purpose of the Zoning Code, and the <br />County General Plan. <br />“(B)The granting of the proposed use shall not be materially detrimental to the <br />public welfare nor cause substantial, adverse impact to the community’s <br />character or to surrounding properties; and <br />“(C)The granting of the proposed use shall not unreasonably burden public <br />agencies to provide roads and streets, sewer, water, drainage, schools, police <br />and fire protection and other related infrastructure. <br />Sam and I, “We are requesting a Use Permit to allow the operation of a cremation <br />business within a portion of a warehouse building situated within the Limited Industrial <br />1-acre (ML-1a) district. The request is to allow the cremation of human and animal <br />remains in EPA approved ovens built specifically for the purpose. We propose to have <br />two full-time employees and operate from 10:00 a.m. to 10:00 p.m. daily. We estimate <br />approximately 50 to 200 people a year and an unknown amount of pets that will utilize <br />the service. <br />“The proposed operation of a cremation business and accessory uses would meet the <br />guidelines for approval of a Use Permit, for the reasons outlined below. <br />“The granting of the proposed use shall be consistent with the general purpose of the <br />zoned district, the intent and purpose of the Zoning Code, and the County General Plan. <br />According to the Zoning Code, Limited Industrial districts ‘applies to areas for business <br />and industrial uses which are generally in support of but not necessarily compatible with <br />those permissible activities and uses in other commercial districts.’ Crematoriums may be <br />permitted in the ML district, provided that a use permit is issued. <br />6 <br /> <br />
