She noted that the new <br />design appears to meet the guidelines of the Master Plan for Kai <br /> <br />Applicant Presentation <br />The applicant, John Hetherington of HawaiÒi Design Group, stated that he believes the <br />new design is more cohesive to the surroundings than the previously approved awnings. <br /> <br />In response to the CommissionersÓ inquiries, Mr. Hetherington clarified that there are two <br />TMK parcels involved, and that the PUD Permit from the Planning Department allows <br />for a bridge between two buildings on those parcels and provides for those buildings to <br />be considered as one regardless of the property line; however, h <br />Building Code might be required since it does not allow crossing over a property line, <br />and added that they are in discussion with the Public Works Building Division about the <br />issue. He also mentioned that the PUD Permit requires a fire sprinkler to be installed, if <br />the bridge area should ever be covered, which the building owner <br /> <br />Discussion <br />Commissioner Harris-Glade opined that before the Commission can render their decision, <br />issues such as variance or amendment to the PUD Permit should be resolved first in order <br />to avoid misconception that the CommissionÓs approval is an overall go-sign. He also <br />expressed his concern that this might set a precedent for disregarding property lines. <br />Commissioner Herbert made an observation that the Commission has, however, approved <br />the previously submitted design for essentially the same project <br />mentioning he will abstain from voting as he has an interest in the subject property, said <br />the applicant understands that this is just a step to get their design approved and there are <br />other requirements they must comply with. Mr. Hetherington said that he is working <br />through various issues simultaneously for his client, and that Daryn Arai of the Planning <br />Department in Hilo, who is processing their PUD amendment request, is glad the design <br />review is happening at this point in time. Mr. Mark said that requesting the <br />CommissionÓs review and recommendation prior to other approvals is consistent with <br />what the Planning Department has done in the past, and that the <br />determine whether or not the applicant has to come back to the Commission, if changes <br />to the design are made afterward. <br /> <br />In response to Commissioner Harris-GladeÓs question, Ms. Newlon said that Coconut <br />Grove Marketplace has 247 parking stalls whereas the minimum requirement by the <br />Zoning Code is 158 stalls. <br /> <br />Action <br />It was moved by Commissioner Ross, and seconded by Commissioner Herbert, to <br />recommend to the Planning Director the approval of the proposed project as submitted. <br />A roll call vote was taken and the motion carried with three aye <br />Kern), one no (Harris-Glade) and three absent and excused (Au Hoy, Bleck and Marone). <br />2 <br /> <br />
