8. All development generated runoff shall be disposed of on-site and not be directed <br /> toward any adjacent properties. <br /> 9. A Solid Waste Management Plan shall be submitted to the Department of <br /> Environmental Management for review and approval prior to the issuance of a Certificate of <br /> Occupancy. <br /> 10. Should any remains of historic sites,such as rock walls, terraces, platforms, <br /> marine sell concentrations or human burials be encountered, work in the immediate area shall <br /> cease and the Department of Land and Natural Resources-Historic Preservation Division <br /> (DLNR-HPD) shall be immediately notified. Subsequent work shall proceed upon an <br /> archaeological clearance from the DLNR-HPD when it finds that sufficient mitigative measures <br /> have been taken. <br /> 11. The applicant shall follow the Weed Risk Assessment referred to in the Division <br /> of Forestry and Wildlife's March 10, 2004 memorandum. <br /> 12. Comply with all applicable rules,regulations and requirements of the affected <br /> agencies, including the Department of Public Works,Department of Transportation, and <br /> Department of Land and Natural Resources Division of Forestry and Wildlife, for the <br /> development of the subject property. <br /> 13. An annual progress report shall be submitted to the Planning Director prior to the <br /> anniversary date of the permit. The report shall include, but not be limited to,the status of the <br /> development and the extent to which the conditions of approval are being satisfied. In order to <br /> enable the Planning Director to monitor whether intersection improvements may be necessary <br /> pursuant to Condition No. 5, the annual report shall include a count of(1) the total number of <br /> visitors, and(2)the number of large tours buses. <br /> 14. An extension of time for the performance of conditions of the permit may be <br /> granted by the Planning Director upon the following circumstances: <br /> A. Non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant,successors or assigns, and that are not <br /> the result of their fault or negligence. <br /> B. Granting of the time extension would not be contrary to the General Plan <br /> or the Zoning Code. <br /> C. Granting of the extension would not be contrary to the original reasons for <br /> the granting of the permit. <br /> D. The time extension granted shall be for a period not to exceed the period <br /> originally granted for performance(i.e., a condition to be performed within one year may <br /> be extended for up to one additional year). <br /> -13- <br />
