I move that the Planning Commission send a favorable <br />recommendation to the Land Use Commission for the request for a special permit, SPP 09-82, <br />based upon public support, public benefit, and the testimony provided today. And if the LUC <br />determines it does not have to ratify the actions of the Planning Commission, then SPP 09-82 <br />will be deemed approved with conditions by the Planning Commission. And is it, do you have <br />some conditions? <br />HAYASHI: If you’d like, Mr. Chairman, I can provide you with the conditions that - . <br />WOODWARD: Yes, I would like to get -. Yes, please; and then I think we ought to ask <br />the applicant if they’re comfortable with it. <br />HAYASHI: Okay, first, I don’t have the exact wording. Basically this is what it is -. <br />WOODWARD: Give us your best shot. <br />HAYASHI: Condition 1 would be the applicants, successors or assigns shall be <br />responsible for complying with all applicable conditions of the permit. Condition No. 2 would <br />be the permit shall be effective for 5 years from the date of approval. And we would have the <br />standard plan approval condition, including landscaping. Condition No. 4 would be that there <br />shall be no on-site disposal of waste or washdown of equipment on the property. Condition 5, <br />comply with all applicable federal, state and county laws, rules and regulations. And, finally, the <br />standard extension condition. Actually that will be all of the conditions. <br />WOODWARD: Well, I would suggest one other, and we mentioned this, that there be no <br />permanent structures constructed in regards to this business -. <br />HAYASHI: Okay. <br />WOODWARD: On the site for this business.
