I think there should be some <br /> middle ground with that, because what he is saying is he is holding a lot of liability of what's <br /> going on—we had an old lady that was beat up in Kimi's parking lot and abused and, she was, she <br /> was beat up. One of our workersI own a restaurant that's opening in Kona Inn, I own a bunch <br /> of different stuff—but they have a hard time, and they don't feel safe walking through their cars at <br /> night because of what has happened in our town. And so just to be able to police it, with that, I <br /> think that takes liability off the County. Am I correct? And liability from him just so he can <br /> actually be able to take it on with that public parking. But seeing some middle ground what needs <br /> to happen, and that's why we are on a discussion right now. <br /> DEFRANCO: But did you ask Sinclair for <br /> KANUHA: Correct? With his, would it be true, he retains all liability if anything was to happen <br /> on there in those public stalls? <br /> SALAS-FERGUSON: It's hard to make a general statement on that. So, what the applicant is requesting is deleting the requirement for <br /> public parking with no replacement, right, which gives them there is a general commitment <br /> saying we want to allow parking, so, to me, that's here, and our option of saying no is here, we are <br /> keeping it exactly as it is. And to me, middle ground is a plan that gets prepared and submitted <br /> and approved by the Director. To me, that's what the middle ground is. <br /> KNOWLES: I agree, and I think there is this strange question about, there is this requirement that <br /> it's public but then he sort of, then the County is saying we have no responsibility because you <br /> own it, but it's public. It's a very, it's an interesting dynamic that we are because I'm thinking, <br /> well, what would prevent the applicant from posting signs that you are, you know, you are towed <br /> at your own expense and putting up a couple of cameras that's a minimal expense. I guess I'm, <br /> I'm a little bit confused about exactly coming from this side all the way to this side and not saying, <br /> well, I put some signs up, I put some cameras up, and that's it. You are basically wanting to <br /> generate revenue to help you offset property taxes or other expenses or, I'm just <br /> FUJIMOTO: Not only that but to clean it up, keep it nice like the rest of the building is. You <br /> know I put a lot of money into the building; I painted it, I put new roof, remodeled the bathrooms. <br /> 18 <br /> EXHIBIT A <br />
