And <br />this Commission did approve that even though the Planning Director ruled against it; and I <br />remember I wound up voting against it, but -. So that stuff is all swirling through my head, too. <br />Thank you. <br />ALAMEDA: Okay. Further discussion items before we entertain a motion? <br />GALDONES:Mr. Chair, I believe you have public testimony. <br />ALAMEDA:We have no testimony, is that correct? <br />NOMURA:No one signed up. <br />ALAMEDA:Nobody signed up. Anybody in the public would like to testify on this <br />matter? Seeing none, we can continue with our discussion. <br />GALDONES:Mr. Chair? <br />ALAMEDA:Commissioner Galdones? <br />GALDONES:In light of the discussions that went with the Director and the request by <br />the Applicant to give him a certain timeline in which to comply with the request to cease and <br />desist the operation, I’m inclined to give the Applicant an opportunity to be able to comply with <br />the request to cease and desist. In terms of the timeline, however, I want to make something fair <br />to the Applicant, also. He’s trying to make a business. As you can see he’s not running a very <br />elaborate operation and probably just struggling to make ends meet. So I’m not so sure what is <br />the -. Where I’m leaning towards is to allow him more, some timeframe in which to be able to <br />reasonably be able to comply and still be able to make a living; and I’m not so certain as to what <br />would be a reasonable timeline. I would like to have the Applicant and the representative to <br />come forth and address that so at least it’ll give us some measure as to what would be reasonable <br />for consideration. <br />ALAMEDA:Okay. Let me check with my fellow Commissioners on their thoughts <br />regarding your proposal. I have a question though, point of clarification, Commissioner <br />Galdones, before we move forward. You mentioned cease and de -, how do you say that again? <br />GALDONES:Cease and desist. <br />ALAMEDA:Cease and desist. What is the “cease” part of this potential application. Is <br />the Applicant asking to “cease” the business? <br />GALDONES:No, the Planning Director is telling him to stop their operation. It’s not an <br />allowable operation on Ag land; therefore, he should stop that and clear out that business from <br />there. <br />ALAMEDA:Okay, okay, cease.
