Bow Engineering & Development, Inc.�� <br />Miloli`i Beach Park Accessibility SSV Application <br />Improvement Project April 6, 2023 <br />In addition, Section 8-11 (c) states: <br />No variance shall be granted unless appropriate conditions are imposed as applicable: <br />(1) To comply with Chapters 10 and 27 of the Hawai `i County Code relating to <br />Erosion and Sedimentation Control and Flood Control, respectively; <br />(2) To maintain safe lateral access along the shoreline or adequately substitute for its <br />loss; <br />(3) To minimize risk of adverse impacts on beach processes; <br />(4) To minimize risk of structures failing and becoming loose rocks or rubble on <br />public property; and <br />(5) To minimize adverse impacts on public views to, from, and along the shoreline. <br />The County of Hawai'i Parks & Recreation will comply with all provisions of Chapters 10 and <br />27. The proposed improvements will not negatively impact the lateral access along the <br />shoreline, but would increase access due to the relocation of the pavilion and installment of ADA <br />sidewalks. Although portions of the pavilion will remain in the shoreline setback, the footprint <br />of the pavilion will be consistent with the existing structure. This should adequately minimize <br />the risk of adverse impacts to beach processes; the pavilion is currently used by beach park users <br />as well as community groups, and its use is expected to continue after the improvements project. <br />Item #5: A scale -drawn plot plan of the property is uploaded to the EPIC site. <br />Item #6: A shoreline survey of the subject property is uploaded to the EPIC site. <br />Item 97: A list of names, addresses and tax map keys of all owners and lessees of record of <br />surrounding properties who are required to receive notice is uploaded to the EPIC site. <br />Item 98: Most of the required documents have been included in the FEA-FONSI or uploaded <br />independently into the EPIC site. The FEA/FONSI prepared according to Chapter 343, HRS, is <br />also in the EPIC site for reference. <br />Please do not hesitate to contact us if you have any questions or need any other documents to <br />support your review and approval. <br />William F.
