person's prohibited activity or to immediately exit the County transit bus, as <br /> determined by the driver of the bus or vehicle, and/or other agent of the transit <br /> system, or a police officer if the officer is on the bus, after the alleged violator is <br /> issued a summons or citation. <br /> (d) There shall be provided for use by police officers a form of summons or citation for use <br /> in citing violators of this article where the circumstances do not mandate the physical <br /> arrest of such violators. The form of the summons or citation shall be commensurate <br /> with the form of other summonses or citations used in modern methods of arrest, so <br /> designed to include all necessary information to make the same valid within the laws <br /> and rules of the State of Hawaii and the County. <br /> (e) The provisions of this article are in addition to and shall in no way limit the provisions <br /> of any other federal,state or County law, ordinance, or rule. <br /> Section 18-99.10. Suspension of service. <br /> (a) The mass transit agency may suspend the provision of mass transit services to <br /> passengers who violate the provisions of Sections 18-99.3, 18-99.6, 18-99.7 and 18- <br /> 99.8. <br /> (b) Before suspending service, the mass transit agency shall notify the individual in <br /> writing: <br /> (1) That the County proposes to suspend service, citing the extent of the <br /> suspension, the basis for, and the length of the proposed suspension or <br /> restriction of service; and <br /> (2) Of their opportunity to appeal the mass transit agency's decision. <br /> Section 18-99.11. Appeals. <br /> (a) Any applicant or passenger who is aggrieved by a decision by the mass transit <br /> agency regarding eligibility or suspension, may appeal the decision to the County <br /> transportation commission. <br /> (b) Appeals must be filed with the commission within sixty days of the date on the <br /> notification of theagency's determination. The appeal shall be effected by filling <br /> out the notice of appeal in a form prescribed by the mass transit agency and filing <br /> the same with the transportation commission. <br /> (c) Within sixty days from the date of mailing or personal service of such notice of <br /> appeal upon the mass transit agency, the commission shall afford the applicant or <br /> passenger an opportunity to be heard andto present information or arguments or <br /> both. The notice and hearing requirements shall conform to the applicable <br /> provisions of Chapter 91, Hawai`i Revised Statutes, as amended. <br /> (d) The transportation commission may affirm, reverse, or modify the decision under <br /> appeal based upon findings of facts which justify the decision. <br /> (e) The commission shall provide a final written decision within thirty days of the <br /> close of the hearing. The County shall not be required to provide services to the <br /> passenger pending the resolution of the appeal. However, if the commission does <br /> not provide a decision within this time, service shall resume or beprovided to the <br /> passenger. <br /> Division 7. Advertising <br /> Section 18-99.12. Advertising inside and outside County transit buses. <br /> (a) The mass transit agency may rent or let advertising spaces inside and outside <br /> County transit buses. The mass transit agency shall promulgate administrative <br /> rules for advertising. <br /> (b) Six standard advertising spaces inside or outside each County transit bus shall be <br /> made available for announcements of a public service, civic or charitable nature.
