MAEDA: Approximately a year ago when I started the process and I went to <br />the Planning Office I had told them I wanted to do a commercial kennel, and at the time <br />they told me that it was a permitted use on agricultural land. Several months later I went <br />back and I asked about the certified kitchen; and in talking with them some more I was <br />informed that both the boarding kennel and the certified kitchen would require a special <br />use permit. But there was a little bit of, it seemed like the County was in transition <br />between not looking at it as a special use permit issue prior to a year ago when I went in <br />as to now. So the other boarding kennels that are already established in East Hawaii are <br />all located on agricultural lands within Light Residential/Agricultural areas where there <br />are houses and other things. So this is not a first; and I don’t know of any kennel except <br />for veterinary clinics that are located just solely in Industrial areas. So I just wanted to <br />make that comment. <br /> <br />WOODWARD: Thank you, sir. We have a very full agenda so if you have <br />pertinent statements or questions please make them. <br />BOWMAN: Just real quick because I think the noise problem -. But isn’t there <br />a noise law that if the dogs bark for more than 20 minutes you can be fined or you can <br />call the police? There’s a law like that, right? So, I mean, if there’s a problem then <br />there’s a legal recourse, I believe. <br />YUEN: There is. How effective it is and how strongly it’s enforced is <br />another question I have to admit. But there is a noise ordinance. <br />BOWMAN: Okay, thank you. <br />WOODWARD: My understanding is it’s generally enforced by the officers of the <br />Humane Society. Okay. <br />HOUSEL: Mr. Chair, I had one question for our Director. <br />WOODWARD: Yes, sir, Commissioner Housel. <br />HOUSEL: In your comments in the recommendation, Mr. Director, you said <br />as a condition of approval the applicant will be required to provide landscaping to <br />mitigate any potential adverse noise or visual impacts to the surrounding areas. Is that <br />specified? Is that a condition of this permit? <br />YUEN: I’m not familiar with the specifics enough. Maija can handle, <br />answer that, I think. <br />COTTLE: Yes, it is.
