so I will ask that you be real specific in your testimony. We have a lot of letters so I’m going ask <br />that you don’t read your letter, ‘cause we’ve already read it; but just speak from your heart and in <br />a concise, as concise as possible, and try not to go off on tangents. If you do, please respect my <br />non-verbal time-out. I’ll bring you right back so we can stay on track. And, also, if you can <br />limit it to about three minutes, that way we’ll get everybody out of here before dark. So, with <br />that, let me take a five-minute recess to just make sure that we get all the testifiers on paper; and <br />if there’s no objection to that, I’d like to do that at this time. Seeing none, five-minute recess. <br />RECESSEDThe Chair called a short recess at 11:26 a.m. <br />RECONVENEDThe meeting reconvened at 11:31 p.m. <br />ALAMEDA:Okay. So it’s little over 11:30 right now and I have a proposal. We have <br />over 27 testifiers and I just wanted to get permission from my fellow Commissioners that I <br />wanted to just hear it all and whenever we end, then we can take lunch. Any objection to that <br />or -? Might be dinner but -.So is there any objection to that? ‘Cause I want to make sure that <br />we honor the folks that are here today. Some of you took off from work and we don’t want to <br />keep you guys any longer than you need to be. So thank you guys for coming. So we’ll just <br />push on through. <br />Agenda Item No. 6, says, “Initiated: Planning Director.” Staff? <br />DARROW:Thank you, Mr. Chairman. At our last Planning Commission meeting, we <br />had testimony in regards to this initiative that has been initiated by the Director. I’d like to just <br />do a little house-cleaning. We’ve submitted to the Commissioners a new second revised <br />Background and Recommendation. It has been distributed to the Commission. I’ll go more into <br />this in a second. <br />Mr. Chairman and Commissioners this hearing was continued from the last Planning <br />Commission meeting in Kona on August 25, 2006 where the Commission heard numerous <br />testimony from the public. Additionally, since our hearing, we’ve received numerous letters, and <br />those have all been passed out to the Commissioners. This morning we have received one letter <br />from Day-Lum Rentals, and I believe the Commissioners have gotten a copy from them. <br />If it’s okay with the Commission, I’m just going to do a short presentation, just reading a short <br />excerpt from the Revised Background so that way we can kind of be on the same page here. <br />ALAMEDA:Sure, Mr. Darrow. Go ahead. <br />DARROW:Thank you. The Planning Director is initiating an amendment to the <br />definition of “family” in the County of Hawai`i Zoning Code. The amendment will address <br />group living facility-type programs that will operate within a single-family dwelling which are <br />licensed and regulated by the Department of Health. The amendment will allow up to eight <br />residents plus any program staff in a group home licensed or certified by the Department of <br />Health. Presently, group homes are limited to five unrelated persons unless they fall under <br />exemptions allowed by the Zoning Code and state law. Within the State Land Use Agricultural <br />District a special permit can be applied for to increase the amount beyond five unrelated persons. <br />These group living programs are meant to be non-institutional and are designed to be operated <br />EXHIBIT D <br />2 <br /> <br />
