numbers of the lots on this map in the south easterly portion of this bulk lot, which is basically <br />where were proposing the development. <br />So, I know that the, Mrs. Barr was an original purchaser, so she received both this map that Im <br />showing you a smaller version and the public offering statement. The Heiss and Maize buyers <br />are subsequent purchasers from our purchaser. So we dont know what was given or what was <br />represented to them in that sale. But we do think that the public offering statement is clear, that <br />the portion of the bulk Lot 70 fronting the Pepeekeo Point was going to be rezoned and <br />subdivided to 11 lots; and thats what were proposing. <br />GALDONES:Thank you, Mr. Lim. Commissioner <br />Siracusa? <br />SIRACUSA:Yes, the Heiss and I guess, Mays it looks like, letter, talks about <br />4pointsasfarasmitigation.Now,PointNo.3which,providingpedestrianaccessalongthe <br />shoreline, including around the light house property, so access is uninterrupted, am I to <br />understand from your earlier comments that that has already been worked out with the <br />community association? And then I want to go on the other points, also. <br />LIM:Well, theres, and Ill have the community association representative <br />explain what their arrangement is. But, basically, our requirements from the settlement <br />agreement with the Planning Director is that we do provide this 10-foot wide pedestrian public <br />access, all along the entire shoreline where we own it. So its that pink line that you can see <br />fronting the property. <br />SIRACUSA:Okay. And then to the Point 4 about access within the SMA from Beach <br />Road to the shoreline access easement, that is also included in there? <br />LIM:I dont know where they want, where they mean that -. But there is public <br />access right here at the Pepeekeo Point, and then from the Beach Road here towards the north. <br />SIRACUSA:Im looking at the map very sideways, thats why its sort of skewed. <br />LIM:Oh, sorry. Okay. <br />SIRACUSA:Yeah. <br />LIM:So the one access point nearest to the Pepeekeo Point project is right here <br />where my finger is right at the south side of the project; then the further to the north there are two <br />further, what they call mauka-makai accesses down to the lateral shoreline. <br />SIRACUSA:Okay. Then they have Nos. 1 and 2, require a significant shoreline <br />setback that is consistent with the 300 feet required for the rest of the project. <br />6 <br /> <br />
