LIM:And I think that we couldnt do that, that basically what theyre reading <br />from is mis-interpreting one of the provisions of the CC&Rs, which resulted from our <br />negotiations with the Planning Director. Currently, on the north side of the project is a 300-foot <br />wide band of Conservation District land. The Director wanted us to make sure that in the event <br />that were able to either reclassify it to Agricultural, or something other than Conservation, or to <br />move the line, have it interpreted further towards the shoreline, that it wouldnt have houses <br />along the north side, closer than 300 feet from the shoreline. And, so, thats the provision that <br />theyre mis-interpreting. <br />SIRACUSA:Okay. And then the final one of their 4 is the height limitation of 12 feet. <br />LIM:Right. I dont think we could live with 12 feet. I think, you know, there is <br />a Zoning Code height limit in the Residential District. And as far as I understand the, I dont <br />know the exact contour of their lots, but I understand that the land generally slopes down <br />towardstheoceanintheareaanyway. <br />SIRACUSA:Thankyou. <br />GALDONES:CommissionerGraham? <br />GRAHAM:Justacoupleofclarificationsfromyou,also,please.Whenwedidthe <br />walk-through, when we did the field visit and all, you all took us first to the north to look at the <br />public access points, and we walked down to the ocean and all, and then, thereafter, we went to <br />the south parcel and also kind of viewed what was down there. Im just wondering, has anything <br />of substance changed in the public access locations, or availabilities, or anything since we did the <br />field trip? <br />LIM:No. The public access locations and alignments -. The only thing that <br />changed was the second to the southernmost alignment was originally located in a drainage area; <br />and what they did was they moved that out of the drainage area up on to the lot so its easier to <br />walk. <br />GRAHAM:Okay. And then, as I recall, on the vehicular side, there was an agreement <br />with the local fishing association that would have key entry at certain times, and all like that. Is <br />that the same condition that were dealing with today? There has been no change on that? <br />LIM:Theres a little bit of modifications there, but theyll discuss that today. <br />GRAHAM:Okay. <br />LIM:And, so, along with the public access easements, the mauka-makai <br />easements, youll have parking areas that theyve cleared and mowed for the cars, for few of the <br />parking, then walk on down. <br />7 <br /> <br />
