SIRACUSA:Question. <br />GALDONES:Commissioner Siracusa? <br />SIRACUSA:So item 16 in the background report that talks about the recovery plan and <br />says that its recommendations from the U.S. Fish and Wildlife Service. The plan recommends <br />that portion of lands of Kaloko above approximately the 3,200 to 3,400 foot elevation and this <br />property falls within that designated as an essential habitat for the 'Alala. The subject property is <br />located within block 8 and the, somewhere else it said that blocks 8 through 13 are designated <br />essential habitat. So it would seem that that is designated there. <br />YUEN:Theres a very formal process for designating critical habitat for any <br />endangered species. This plan was a recommendation that wasnt implemented. They never, <br />theydidntactuallydesignatethecriticalhabitatforthe'Alalainthisarea. <br />SIRACUSA:DidtheydesignateitinotherareasbecauseIknowpartoftheendangered <br />species law requires that critical habitat be named for any listed species. <br />YUEN:I am not sure if there is critical habitat; if there was an area that was <br />designated critical habitat for the 'Alala. <br />SIRACUSA:If Mr. Mooers knows the answer to that then I will hold my question until <br />he comes up. <br />GALDONES:Are there any further questions? Commissioner Graham? <br />GRAHAM:One and my understanding may not be quite right on this but Im <br />comparing this application with the one before. Both of which we have correspondence <br />indicating theres road impacts at the intersection of the roads. In this instance it looks like <br />theres an agreed upon amount of money thats supposed to be the fair share contributions to <br />work towards mitigating the road impacts and it looks like the applicant has to put the money up <br />front. Whereas in the one before it seemed like the applicant is required to pay a later date sum, <br />amount to be determined at a later date. So, I may have that wrong but it seems a little unusual <br />that the 2 are handled in such a different manner. Do you have any comment on that? <br />HAYASHI:Youre talking about Condition L? Commissioner Graham? <br />Commissioner Graham is that Condition L youre referring to? <br />GRAHAM:Yes. <br />HAYASHI:Okay that is a condition that we normally use for this particular, rezoning <br />in this particular area. We may have in the past stated that they had to contribute 3,600 dollars <br />towards the improvement of that intersection to be put in a pot but we decided over recent years <br />to put a condition that they contribute their fair share contribution as noted in condition 11. So if <br />there was something that we did recently thats different then Im not too sure about that. <br />EXHIBIT B <br />3 <br /> <br />
