KUBOTA:Was that the -, that this new subdivision has its own egress and ingress <br />farther north and you touched on that. We have problems with the Department of <br />Transportation in that and the drainage. <br />He also suggested that perhaps Nani Kailua, the main road, lateral access, be used by the <br />construction trucks and so forth, traffic, only until such time as the infrastructure is built to <br />accommodate this new subdivision. Can we block off roads from usage by vehicles in that <br />nature? I mean it's a public road, isn't it? It's not a private road. Does anyone have the right <br />to say it's prohibited? <br />YUEN:I know what you're saying, but I think in theory you could put a <br />condition on a rezoning regarding uses of roads by construction vehicles for that. <br />KUBOTA:Oh. <br />YUEN:Because -, as a condition of rezoning. It would be a violation by the <br />landowner. We would expect the landowner to make the construction company comply. The <br />police could not cite the construction vehicles on the road going back and forth because of it <br />being a public highway. As long as they -, as long as those vehicles complied with the normal <br />vehicle code. You could, in theory, make a condition of a rezoning. In practice, in this case, <br />I don't see how they're going to get construction vehicles up there without using Nani Kailua. <br />KUBOTA:Well, I -. <br />YUEN:Or they could go on Aloha Kona, parallel -. <br />KUBOTA:There was -, it was even further than that. <br />YUEN:Yes. <br />KUBOTA:Mr. Planning Director. As I understood, his suggestion was that in the <br />interim, the construction vehicles use Nani Kailua, but after the infrastructure is set for their <br />own subdivision and they have egress and ingress of their own, that the use of Nani Kailua be <br />prohibited.
