ALAMEDA:Mr. Vurich, go ahead. Could you finish your argument. <br />MR. VURICH:Yes, yes, I will. The inspector did come back out and told us everything <br />was okay. The plants are planted. And we dont know what else to say except thats what the <br />objection the County had with the sides, that we tried to be good guys and put bougainvillea, and <br />now we have put in all of the jasmine. If fact, we double-planted it in case some of them didnt <br />make it. Thats it. <br />ALAMEDA:Okay, thank you. Now Im going to turn it over to our intervenor for your <br />oral argument. Mr. Eger? Hold on. We have a question, Mr. Salavea? <br />SALAVEA:Are we hearing evidence, this is just a clarification, are we hearing <br />evidence on what is existing or on the application? Cause its going back and forth and Im <br />gettingconfusedifyouretalkingaboutyourcurrentapplicationoryouretalkingaboutyour <br />current business, commercial business thats going on. And I just want to know for my own <br />purposes as a Commissioner that Im supposed to be listening, well, receiving information based <br />on the current application and then Im going to base my, well, decision on that information and <br />disregard all information relating to the current commercial business thats going on. <br />ALAMEDA:Thank you. <br />SALAVEA:Does that make any sense? <br />ALAMEDA:That makes a lot of sense, Commissioner Salavea. As noted by Ms. <br />Leithead-Todd that if we stick to the application we might move this a lot faster. Thank you. <br />SALAVEA:Thank you. <br />SIRACUSA:Excuse me. <br />ALAMEDA:Commissioner Siracusa? <br />SIRACUSA:Yes. There was some discussion in the hearing transcript related to the <br />point that there was going to be consolidation of the two parcels and the whole thing is going to <br />be operated as one business. And you cant, therefore, disregard one part of it because the whole <br />thing is going to be a single cohesive unit eventually if this will, gets approved and the whole <br />thing goes through. So I dont see how we can disregard what happened in the previous permit <br />because thats going to end up being subsumed. <br />ALAMEDA:Thank you, Commissioner Siracusa. Mr. Torigoe, you wanted to respond <br />to that? <br />TORIGOE:Yeah, I think thats a good point; and you need to exercise some care in, <br />you know, making sure you focus on the current application but there may be some aspects of <br />the operation of the existing uses that are relevant to your consideration of the current <br />application. So I wouldnt want to say that you should just cut off everything that has to do with <br />11EXHIBIT B <br /> <br />
