So some reference to, this is, I€m talking about the <br />application property, I€m talking about the existing commercial business going on, some <br />reference for us to discern between what evidence you€re giving so that we can, you know, put <br />that in proper context. <br />ALAMEDA:Point well taken, Commissioner Salavea. Mr. Eger, oral argument? <br />EGER:Yes. <br />ALAMEDA:Proceed. <br />EGER:Thankyou,Mr.Chairman.IperhapswasclumsybecauseIwasn€t <br />meaning to bring up the issue of landscaping. I was meaning to bring up the violation of the <br />condition, because as I tried to make clear that is the substance of my problem and the problem <br />of our community. We have a very good stack of petitions that were submitted. The property is <br />described over and over again as an eyesore. Now if we want to talk about landscaping, I have <br />very little to say because there is none. It is weeds along the entire face of, against Kaloli. There <br />is no landscaping whatsoever on the other, on the backside, nor on the side away from Kaloli, <br />whereas the requirement is that there will be perimeter landscaping, that is around the entire area. <br />Landscaping is also by its nature taken care of, pruned, kept away from danger. Because where <br />th <br />it is on the corner at 13 <br /> and Kaloli it is a site hazard for those vehicles coming out of 13th and <br />turning, trying to turn into Kaloli one way or the other. You cannot see the traffic on Kaloli. <br />Now those are clear matters that can be satisfied quickly. <br />However, again and again, my issue before this Commission is that unless conditions are <br />enforced that they do no good for the community, the Commission or the planning for this <br />County. And I€ve heard some matters to that effect on your first hearing today. Conditions are <br />set but there is no pattern for enforcement within the County. When this issue was raised about <br />the landscaping to me early on by Mr. Schneider, I suggested that if he had a problem with the <br />landscapingthathefileacomplaint.Thatisacomplaintwhichwasruledinviolationearlier. <br />And when I inquired about that at the contested case hearing, if you had a chance to read that <br />transcript,theysaid,well,wedonottestanyoftheseissuesonconditionsunlessthereisa <br />complaint. Well, my suggestion to you, sir, is that people in general have no way of knowing <br />whatthoseconditionsare.Thepublicdoesnotknowtheconditionsthatareplacedbythis <br />Commission, by the Department of Planning on any of the, on the special use permits or on <br />changeofzoning.Andtheyneedtobegivenmoreofachancetohavetheprotectionoftheir <br />government when those conditions are placed. <br />My suggestion to you relative to this concern and the way I want to bring it to your attention <br />mostforcefully,acrossthestreet,acrossKaloli,thereisa20-acreparcelthatiszonedfor <br />industrial.
