WATANABE:Im sorry, but I believe you already heard testimony from the County that <br />it had no regard to standing so I dont understand where this is going. <br />EGER:Pardon me, Im getting there. During the contested case hearing, Mrs. <br />Todd on several occasions brought in highly personal complaints about Sarah Harlan based on <br />the position of her property, whether it was going to be across the street from an industrial area, <br />and I raised an objection. The hearing officer did not admonish her. So Im saying that -. <br />SALAVEA:Can you point to those in the minutes from the hearing for us to review? <br />EGER:Well, theyre right here. Theyre on page 116 which was the summation <br />as the representative of Chris Yuen at the contested case hearing; and I have a hard time <br />believing that he would agree with that summation. It was mostly personal against the client. <br />ALAMEDA:Whileyourelookingatthat,letmeask-.Mr.Torigoe,soinresolving <br />this matter, is it on the protocol then to kind of hear what the intervenor has to say and then just <br />bring it back to the Commission, or do I have the final authority on that? <br />TORIGOE:As the presiding officer, since this is a non-dispositive motion you as the <br />presiding officer would make the decision. <br />ALAMEDA:Okay. Fellow Commissioners, Im inclined to deny the objection and <br />allow Ms. Leithead-Todd to proceed. Is there any objection to that? <br />MCCALL:No. <br />ALAMEDA:Commissioner Siracusa? <br />SIRACUSA:I, well, not objecting to it. Actually, I read the transcript very carefully <br />and I read the exceptions very carefully and its my impression that Mr. Eger is misinterpreting <br />what Ms. Leithead-Todd was doing. And I feel that if we say she cant continue now then we <br />are denying the County their right of representation. I dont feel comfortable with that either. <br />And although I must admit that I am not favorably disposed towards the applications of the <br />Vurich, which Ive made clear previously, I do believe that, I would support your decision if you <br />wanted to rule that Ms. Leithead-Todd could continue on. <br />ALAMEDA:Okay. Id like to ask Corp. Counsel if I could make that now, for the <br />record? <br />TORIGOE:Well, if the parties are done with their presentations on this matter, yes. <br />ALAMEDA:Okay. <br />EGER:May I just mention, Mr. Chairman -? <br />ALAMEDA:Go ahead, Mr. Eger. <br />19EXHIBIT B <br /> <br />
