Would you like Mr. Fuke to share it <br />with us that language? <br />SPRINGER:Yeah; and if its in the form of a new condition, or if it would be added to <br />E, or some other one. <br />ALAMEDA:Okay. Mr. Darrow, would you mind reading that for the Commissioners? <br />FUKE:Actually on that, it would really be like on proposed Condition E. What it <br />justsaysis,Restrictivecovenantsinthedeedsofalltheproposedlotsshallincludeprovisions <br />that require the height of all structures to not exceed 35 feet and consultation with the immediate <br />adjoining property owners regarding the placement of all structures prior to submittal of plans for <br />a building permit. Again, you know, its not to say that the adjoining property owner has any <br />veto power. But what you want to do is create like a sense of community that, you know, you <br />just talk story and hopefully you can kind of resolve things. I mean, you are going to be <br />neighbors so thats what it kind of mandates, yeah. <br />ALAMEDA:Director? <br />YUEN:When it talks about consultation with adjacent property owners, does it <br />mean that somebody in the subdivision has to consult with another member, with another owner <br />within that same subdivision, or are you talking about adjoining property outside of this <br />rezoning? <br />FUKE:Were talking about the immediately adjoining properties. <br />YUEN:So if I, say this ends up in a subdivision being Lots 1 to 5, if I buy Lot 2, <br />do I have to consult with the owner of Lot 3? <br />FUKE:No, the -. Thats a very good question. I think I understand <br />what -. <br />YUEN:The way you wrote it, I think thats what it does, yeah. <br />FUKE:Oh, okay. <br />YUEN:And we can, if the idea, I think we should identify the, possibly just <br />identify the tax map keys of the, what we mean by adjoining properties because, again, you <br />know, say if you have, if its meant to be in favor of the people immediately mauka of this then <br />the person, once you subdivide it, for example, Lot 3 may not, its not adjacent to that anymore. <br />FUKE:I got you.
