2. Reasons for the Request: The applicant's reasons for the request are as follows: <br /> ■ Deletion of Conditions B and C: The applicant is requesting deletion of these <br /> timed construction performance conditions for the following reasons: 1)they <br /> believe that the property and surrounding area has always been slated for <br /> industrial/commercial uses as evidenced by its original MG-la zoning in 1967 <br /> and the remainder of the property's CV zoning since 1971 and that continuation <br /> of the CV zoning would be the most suitable land use designation ; 2)the <br /> applicant has completed all of the ordinance required off-site infrastructure <br /> improvements and other off-site infrastructure is available to the property; 3)the <br /> absence of any on-site development issues (drainage, archaeological/cultural, <br /> etc.); and 4)the zoning's continued consistency with the General Plan and Kona <br /> CDP. Based on the preceding, it is appropriate to allow the entire parcel to be <br /> developed as the market demands and not with artificial timeframes on a smaller <br /> portion of the property. <br /> ■ Deletion of Conditions D and F: As discussed further below, the applicant has <br /> completed improvements to `Eho Street as required under Condition D and <br /> dedicated the improved roadway to the County via resolution. The applicant has <br /> also completed improvements to the `Eho Street/Queen Ka`ahumanu Highway <br /> intersection meeting with the approval of the Department of Public Works (DPW) <br /> and the Department of Transportation (DOT) as required by Condition F, thus the <br /> applicant requests deletion of these completed conditions. <br /> ■ Deletion of Condition K: The Zoning Code was recently amended to prohibit the <br /> addition of conditions to any change of zone ordinance which allows the Planning <br /> Director to grant an administrative time extension (see HCC Section 25-2-44(c)), <br /> thus the applicant is requesting deletion of Condition K. <br /> 3. Proposed Development: Although the applicant has marketed the subject parcel to <br /> potential developers, the project site is not currently leased, thus there is no current <br /> proposed development.
