Looking at the site plan of the property, as youre coming from the Honokaa-Waipio <br />Road, you will come, traveling in this direction, there is a driveway that will bring you <br />onto the property. There are numerous structures on the property identified from A, A is <br />the proposed structure. From B on to H are artistic structures. <br />The Applicants in this case, David and Sharon Pettus, are requesting a Special Permit to <br />allow a Wellness Retreat Center and related improvements on 12.157 acres of land within <br />the State Land Use Agricultural District. <br />This is in response to a warning letter that was issued by the Planning Department for <br />having five unpermitted structures on the property. There is one structure, one dwelling <br />structure, that is permitted but not final at this time; and there are structures that were <br />permitted as sheds as well. <br />ThePlanningDepartmenthasreceivednumerouslettersofsupportaswellasopposition <br />in regards to this application. We have received, as well, two petitions for standing in a <br />contested case hearing. One is from Gary Washburn, his property is identified on the <br />makai side of the Applicants property. And we have a request from Cheryl Green, who <br />is located adjacent on the mauka of the Applicants property. <br />At this time, we are withholding the Rec based on the submittal of the contested case <br />hearing requests. Are there any questions? <br />FUJIKAWA:Thank you. Commissioners, any questions with the staff? <br />SPRINGER:Mr. Chair? <br />FUJIKAWA:Springer? <br />SPRINGER:Yes, I have procedural question. The first item that we need to <br />take up then is the matter of the contested case, is that correct? <br />FUJIKAWA:Yes. <br />SPRINGER:And, if so, could we proceed with the contested case today, or do <br />we need to put it on the agenda for a future meeting? <br />FUJIKAWA:Director? <br />YUEN:The Commission has the option of hearing the contested case today <br />as a body if they wish. <br />SPRINGER:Do we need to, do we first ascertain, if the Applicants for Standing <br />are approved, if they are prepared to continue today? <br />YUEN:Yes, and I would suggest asking the Applicant the same. <br />2 <br /> <br />
