Highlands Golf Estates to Waik6loa Mauka, LLC, however the subject property was not <br />included in the sale. <br />10. December 15, 2005: Ordinance No. 05-157 approved a time extension of ten additional <br />years and added new conditions for the proposed subdivision. <br />11. September 20, 2007: Ordinance No. 07-127 amended the previous ordinance by <br />modifying some conditions. <br />12. March 13, 2013: Ordinance No. 13-029 approved a time extension of ten additional <br />years, amended several conditions and of note, the heading of this ordinance did not <br />include the subject property, identified at the time as TMK: (3) 6-8-003: portion of 032. <br />As a result, the subject property is covered by Ordinance No. 07-127, but not included in <br />the most current ordinance pertaining to the Highlands Golf Estates project. <br />STATE & COUNTY PLANS <br />13. State Land Use District: Urban. <br />14. General Plan Land Use Pattern Allocation Guide (LUPAG) MAP: The subject <br />property is designated Medium Density Urban and Industrial. In a letter dated March 13, <br />2023, the Planning Department confirmed to the applicant that the LUPAG designation <br />for the subject property can be interpreted as Industrial for rezoning purposes (see Exhibit <br />15 of Application). <br />15. County Zoning: Open (0). <br />16. South Kohala Community Development Plan (SKCDP): The SKCDP, adopted on <br />November 20, 2008, by Ordinance No. 08-159, depicts the subject property as within an <br />area planned for a "commercial center." <br />17. Special Management Area (SMA): The Special Management Area is a part of the <br />Coastal Zone Management Program and regulated by the County. The subject property is <br />not located within the Special Management Area and is situated approximately 4.7 miles <br />from the nearest coastline. <br />DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA <br />18. Subject Property: The subject property is approximately 29.61 acres in size and <br />irregular in shape. The area of the proposed rezone is a 26.052 -acre portion located makai <br />of `Auwaiakekua Gulch with the remaining 3.558 -acre portion located mauka of the <br />-3- <br />
