Merit Appeals Board <br />February 23, 2024 <br />Please note that MAB requires one original and eight copies for all submittals. Okay, so that <br />concludes this matter. Thank you, Mr. Thomas. <br />MR. THOMAS: Thank you. <br />CHR. CABANAS: And, Ms. Tavares, thank you for coming today and we'll see you on <br />April 25h. <br />New Business (Item 6) <br />CHR. CABANAS: Okay, so we don't have any "New Business." <br />Unfinished Business (Item 7) <br />Discussion Concerning The Appeal Process For Individuals Who File An Appeal <br />(Note: The Above Matter Was Listed On The October 25 and December 21, 2023, and <br />February 23, 2024, Merit Appeals Board Agenda) <br />CHR. CABANAS: But we are now moving on to "Unfinished Business" the discussion <br />concerns the appeal process for individuals who file an appeal. <br />And there is a fact sheet for the appeal hearing process, from the Merit Appeals Board, that I <br />initially drafted, worked on, edited, and reviewed by Mr. Yoshimoto, our Assistant Corporation <br />Counsel; and our Secretary -Reporter, Glynis Yamada; and our Deputy Attorney General in <br />Honolulu. <br />Have you all had the opportunity to review this fact sheet? Okay, so while you're doing that, I <br />just want to explain to those that are present. We've had instances where appellants appear <br />before the Merit Appeals Board with no representation. And the Board members have observed <br />that they appear lost as to what's involved in an appeal. The last person was lost and indicated <br />such. He didn't realize it was a formal appeal hearing. <br />And in a formal appeal hearing, there's protocol. And so, what we did was we tried to draft just <br />a general summary, which Glynis has provided you folks with a copy of. So, you can review it. <br />I'll pause for now and you can, kind of, read through it. <br />So, put yourself in the position of an appellant. Would this be helpful to you as an appellant? <br />MR. KUNZ: I did have one questionI don't know, maybe for J to distinguish what is meant <br />by "strict rules of evidence will not apply." <br />MR. YOSHIMOTO: Okay. Generally, that term means that while the rules of evidence can be <br />utilized, it won't be strictly adhered to. In other words, if there's objections, the Board has a <br />latitude to either follow it or not. <br />Page 14 <br />
