COASTAL ZONE MANAGEMENT ACT,CHAPTER 205A,HRS S N/S N/A <br /> (Key:S=Supportive,N/S=Not Supportive,N/A=Not A licable <br /> Discussion: This application discusses potential impacts and mitigation measures of the proposed Winter Farm <br /> project which will be reviewed by the Planning Department and the Windward Planning Commission.As part of <br /> the application process two public notices to surrounding property owners and lessees of record are required. <br /> Objective: A Protect beaches or public use and recreation. <br /> Policies: <br /> (A) Locate new structures inland from the shoreline setback to conserve open space, X <br /> minimize interference with natural shoreline processes, and minimize loss of <br /> improvements due to erosion; <br /> (B) Prohibit construction of private erosion-protection structures seaward of the shoreline, X <br /> except when they result in improved aesthetic and engineering solutions to erosion at <br /> the sites and do not interfere with existing recreational and waterline activities;and <br /> (C) Minimize the construction of public erosion-protection structures seaward of the X <br /> shoreline. <br /> (D) Prohibit private property owners from creating a public nuisance by inducing or X <br /> cultivating the private property owner's vegetation in a beach transit corridor;and <br /> (E) Prohibit private property owners from creating a public nuisance by allowing the private X <br /> property owner's unmaintained vegetation to interfere or encroach upon a beach transit <br /> corridor. <br /> Discussion: Except for livestock fencing,as discussed above,the proposed Winter Farm project will be set back <br /> at least 100 yards from the shoreline.The Applicant has no plans to induce or cultivate landscaping that would <br /> interfere or encroach upon the shoreline's lateral public transit corridor. <br /> Marine Resources <br /> Objective:(A)Promote the protection, use, and development of marine and coastal resources to assure their <br /> sustainabili . <br /> Policies: <br /> (A) Ensure that the use and development of marine and coastal resources are ecologically X <br /> and environmentally sound and economically beneficial; <br /> (B) Coordinate the management of marine and coastal resources and activities to improve X <br /> effectiveness and efficiency; <br /> (C) Assert and articulate the interests of the State as a partner with federal agencies in the X <br /> sound management of ocean resources within the United States exclusive economic <br /> zone; <br /> (D) Promote research, study, and understanding of ocean processes,marine life, and other X <br /> ocean resources in order to acquire and inventory information necessary to understand <br /> how ocean development activities relate to and impact upon ocean and coastal <br /> resources;and <br /> (E) Encourage research and development of new, innovative technologies for exploring, X <br /> using,or protecting marine and coastal resources. <br /> Discussion: The objective and policies of"Marine Resources"are not applicable to the proposed Project. <br /> 14 <br />
