(B)Any development which would reduce the size of any beach or other area usable <br /> for public recreation; <br /> (C)Any development which would reduce or impose restrictions upon public access <br /> to tidal and submerged lands, beaches, portions of rivers and streams within the <br /> special management areas and the mean high tide line where there is no beach; <br /> (D)Any development which would substantially interfere with or detract from the line <br /> of sight toward the sea from the state highway nearest the coast; and <br /> (E)Any development which would adversely affect water quality, existing areas of <br /> open water free of visible structures, existing and potential fisheries and fishing <br /> grounds, wildlife habitats, or potential or existing agricultural uses of land. <br /> Discussion: The proposed Project: <br /> • Does not involve dredging, filling or otherwise altering any bay, estuary, salt marsh, <br /> river mouth, slough or lagoon; <br /> • Will not include any development within the Shoreline Setback, and thus will not: <br /> o Reduce the size of any beach or other area usable for public recreation (such as <br /> fishing); <br /> o Impose restrictions upon public access to tidal and submerged lands, beaches, <br /> portions of rivers and streams within the special management areas, and the mean <br /> high tide line where there is no beach; or <br /> o Interfere with or detract from the line of sight toward the sea from the State <br /> highway nearest the coast, as the nearest State Highway is Hawaii Belt Road, <br /> which is approximately 1.7 miles away from the Site.None of the proposed <br /> above-ground development of the Site or its coastline is visible from Hawaii <br /> Belt Road, and that should remain unchanged. <br /> The above-ground components of the proposed development could not affect <br /> scenic views towards the ocean from the intersection of Lehua Street and <br /> Waipi`o Road, or the intersection of Lehua Street and Haina Road,because the <br /> topography shields them from view. The proposed development will not include <br /> above ground utility lines or poles that would alter views. <br /> • Will not adversely affect: <br /> o Water quality because: <br /> ❑ There is no need for rain/stormwater runoff retention ponds. The property <br /> uphill has a huge plantation era holding pond blocking most runoff onto the <br /> site. The planned hardened, developed areas are small and are protected with <br /> 17 <br />
