Land Use Commission Rules: <br /> HAR section 15-15-01 states that the Land Use Commission's Rules "Shall be <br /> liberally construed to preserve, and encourage the development and preservation <br /> of lands in the State for those uses to which they are best suited in the interest of <br /> public health and welfare of the people of the State of Hawaii." Based on the <br /> discussion above that addresses the objectives of HRS 205 and HRS 205A, the <br /> applicant believes the proposed project is not contrary to the objectives sought to <br /> be accomplished by the Land Use Commission Rules. Section 9, paragraph G <br /> provides a thorough examination of this project's compliance with the County <br /> General Plan. <br /> B. The granting of the proposed use shall not be materially detrimental to the public <br /> welfare nor cause substantial adverse impact to the community's character or to <br /> surrounding properties; <br /> Land Use Commission Rules do not describe the impacts that must be considered <br /> in determining whether a proposed use adversely affects the community's <br /> character and surrounding properties. The applicant will discuss several of the <br /> potential impacts: <br /> The subject parcel is long and polygon shaped; and 12.381 acres in size. The <br /> property is zoned Residential(RS-10) and is primarily used as a residence and <br /> church. There is unused land to the immediate north and west, and a school to the <br /> far north. There are residential neighborhoods to the east and south. The applicant <br /> believes the proposed use of the subject property will not adversely affect the <br /> surrounding properties or their present use because the existing parcel is being <br /> used for church activities. <br /> The operation of the cellular radio antennas have filter equipment and operate in <br /> the ultra-high frequency radio wave band, between 800 to 2000 megahertz. The <br /> propagation pattern of the antennas are directed towards the horizon for maximum <br /> effectiveness and not downward. Thus the radio frequency energy near the base <br /> of the tower is minimal. <br /> 13 <br />
