12. Zoning Complaint: County records show a complaint was submitted regarding the subject <br /> property, alleging use of unpermitted cabanas as vacation rentals. Following an <br /> investigation, county inspectors issued a warning letter to the applicants, dated September <br /> 29, 2022, with findings noting the presence of 6 unpermitted cabana structures and a <br /> dwelling being used as a hosted vacation rental. As stated in the letter, the NUC/STVR <br /> registration allowed a 3-bedroom un-hosted vacation rental and did not include use of <br /> cabanas and/or cabins for guest accommodations. Further, the letter requested that the <br /> applicants cease advertising unpermitted structures as guest accommodations and <br /> recommended that the applicants submit a special permit application if they want to request <br /> use of the property beyond what was approved with the NUC/STVR registration. <br /> (Planning Department Exhibit 2—Warning Letter dated September 29,2022). <br /> STATE & COUNTY PLANS <br /> 13. State Land Use District: Agricultural. <br /> 14. General Plan Land Use Pattern Allocation (LUPAG)Map: The General Plan LUPAG <br /> map classifies the subject property as Important Agricultural Land(ial)which refers to land <br /> that has better potential for sustained high agricultural yields because of soil type,climate, <br /> topography, or other factors. <br /> 15. County Zoning: Agricultural-20 acres (A-20a). <br /> 16. Hamakua Community Development Plan (RCDP): The HCDP was originally adopted <br /> by the Hawaii County Council as Ordinance 2018-078 in August 2018. The HCDP <br /> objective is to promote,preserve and enhance a diverse, sustainable, local economy and to <br /> encourage the increase and diversity of employment and living options for residents, <br /> including living wage jobs and entrepreneurial opportunities that allow residents to work <br /> and shop close to home and that complement Hamakua's ecology, rural character, and <br /> cultural heritage. <br /> 17. Special Management Area (SMA): The property is not within the County's Special <br /> Management Area and is located approximately 0.5 miles west (mauka) of the nearest <br /> shoreline. <br /> 18. Coastal Zone Management: The entire State of Hawaii lies within the Coastal Zone <br /> Management area. <br /> -3- <br />
